RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Waive the requirements of the Humboldt County Nuclear-Free Ordinance with regard to the attached memorandum of understanding with the Transaction Record Analysis Center;
2. Approve, and authorize the District Attorney, or a designee thereof, to execute the attached memorandum of understanding with the Transaction Record Analysis Center regarding access to the TRAC Money Transmitter Data system; and
3. Authorize the District Attorney, or designee thereof, to execute any and all subsequent amendments to the attached memorandum of understanding with the Transaction Record Analysis Center, after review and approval by County Counsel, Risk Management and the County Administrative Office.

DISCUSSION:
In February, 2010, a settlement agreement was reached between the State of Arizona and Western Union Financial Services. As part of the settlement agreement the third-party monitoring service known as the Transaction Record Analysis Center was created for purposes of enhancing and better coordinating investigations and prosecution of illegal money laundering activities. The attached memorandum of understanding with the Transaction Record Analysis Center will allow the Humboldt County District Attorney's Office to access the TRAC Money Transmitter Data System and receive analytical and data-related assistance and training.
Accordingly, staff recommends that the Board approve, and authorize the District Attorney, or a designee thereof, to execute the attached memorandum of understanding with the Transaction Record Analysis Center regarding access to the TRAC Money Transmitter Data system.
