RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve the Subtenant Agreement between the County of Humboldt and Long Prairie Gun and Archery Club (LPGAC);
2. Authorize the Chair of the Board of Supervisors to sign the Subtenant Agreement; and
3. Direct the Clerk of the Board to return three (3) fully executed Subtenant Agreements to Public Works Real Property.

DISCUSSION:
LPGAC leases approximately 16 acres of timber lands from The Green Diamond Resource Company (Landowner). LPGAC sublets these 16 acres to various law enforcement agencies as gunnery ranges for firearms training. (Exhibit A - Site Plans).

On Aug. 20, 2019, your board approved a Subtenant Agreement with LPGAC to allow the Humboldt County Sheriff's Office (HCSO) and the District Attorney's Office (DA) to use the gunnery ranges within these 16 acres (Exhibit B - Expired Subtenant Agreement). The use is for peace officers of HCSO and the DA to maintain firearm proficiency and training requirements. The Subtenant Agreement expired on Dec. 31, 2019. The HCSO and DA have continued use of the Subtenant Agreement on a month to month tenancy (holdover period) on its same terms and conditions.

HCSO and the DA wish to enter into another Subtenant Agreement using the same terms and conditions of the prior Subtenant Agreement (Attachment No. 1 - Subtenant Agreement). The Landowner will allow LPGAC to continue subletting to various law enforcement agencies, provided the Subtenant Agreement terms are on an annual basis. The Landowner does not want any encumbrances (Agreements) on their lands should they try to obtain a Timber Harvest Permit.
