RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Grant a waiver of the Nuclear Free Ordinance;
2. Authorize the Chair of the Board to sign and execute the attached Sheriff's Woodley Island Boat Slip Rental Agreement; and
3. Direct the Clerk of the Board to return the executed Rental Agreement to Public Works - Real Property, for transmittal to the Humboldt Bay Harbor, Recreation, and Conservation District.

DISCUSSION:
On Oct. 10, 2019, your Board approved the Sheriff's Department Woodley Island Boat Slip Rental Agreement to utilize a 50-foot moorage facility for its boat at Woodley Island. The boat is used to enforce state and local boating regulations, inspection of vessels, and search and rescue operations.

The Sheriff's Department is requesting Board approval and execution of the attached Woodley Island Boat Slip Rental Agreement for continued use of the moorage facility from Jul. 1, 2021 to Jun. 30, 2022.

A waiver of the Nuclear Free Ordinance is requested because the Boating Unit has decided to use the Marina's standard slip rental agreement, which does not contain the Nuclear Free Ordinance language.

FINANCIAL IMPACT:
Current monthly rental amounts up to Jun. 30, 2021 is Two Hundred Fifty-Two Dollars ($252.00), which consists of charges for float replacement, dredge surcharge, and moorage costs. Effective Jul. 1, 2021, these costs will increase by approximately Thirty-Eight Dollars and Fifty Cents ($38.50) for a total monthly cost of Two Hundred Ninety Dollars and Fifty Cents ($290.50). The Sheriff's Department will pay12 months in advance for a total of Three Thousand Four Hundred Eighty-Six Dollars ($3,486.00) for fiscal year 2021-22.
