RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached first amendment to the project takeover agreement with Western Surety Company regarding the Humboldt County Juvenile Hall Facility Replacement Project; and
2. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached first amendment to the project takeover agreement with Western Surety Company to the County Counsel's Office for further processing.

DISCUSSION:
On October 8, 2019 (Item L-5), the Board of Supervisors approved a project takeover agreement with Western Surety Company ("Western") which arose out of the County of Humboldt's termination of the original construction contract for the Juvenile Hall Replacement Facility Project ("Project") with Hal Hays Construction, Inc. The project takeover agreement requires Western to complete the Project by August 30, 2020, confirms that Western will be responsible for costs to complete the Project in excess of the remaining contract balance and assigns, at Western's cost, a third-party construction consultant, Benchmark Consulting Services, LLC, as Western's authorized representative. The attached first amendment to the project takeover agreement with Western will allow J.S. Held, LLC to take the place of Benchmark Consulting Services, LLC as Western's authorized representative under the terms and conditions of the project takeover agreement.
FINANCIAL IMPACT:
