RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Authorize the Chair of the Board to sign the License Agreement between the County of Humboldt and Green Diamond Resource Company effective Jan. 1, 2024 (Attachment 1); and
2. Direct the Clerk of the Board to return the executed License Agreement to the Department of Public Works Land Use Division for further processing.

DISCUSSION:
The Road Division of the Humboldt County Department of Public Works has been using the Stover Road Disposal Site since 2005. The Oct. 1, 2019, License Agreement expired Dec. 31, 2023, and a new License Agreement is necessary. The new License Agreement (Attachment I) shall permit the county to enter upon said property (AP 531-022-002) for the purpose of disposing of clean rock and earth derived from county road repairs and maintenance in the Redwood Creek Valley area. The new License Agreement would have a retroactive effective date of Jan. 1, 2024 and would remain in full force and effect until Dec. 31, 2029. This new License Agreement has a retroactive effective date of Jan. 1, 2024, to cover County's continued use of the stockpile site after the expiration date of the last extension, which was Dec. 31, 2023.
The rental rate for use of said site shall be $1,000 per year, payable in advance, on an annual basis, at the sum of $1,000 each year. The new License Agreement stipulates that annual site payments shall be made payable prior to Jan. 1 of each calendar year.
