RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Discuss the need for changes in the existing language in Ordinance 2554 regarding dispensary operation hours; and

2.                     Direct staff to bring back a new ordinance that aligns the local hours of dispensary operation with the state laws.

DISCUSSION:

The Board of Supervisors adopted the Medical Marijuana Land - Use Ordinance Title III 313-55.3 Medical Cannabis Dispensaries on July 19, 2016.  Since then the state legislation has evolved and expanded the laws under the Bureau of Cannabis Control.  One important change has been the approved operation hours for medical cannabis dispensaries.  The State allows the operation hours from 6:00am to 10:00pm whereas the current county ordinance only accommodates the operation hours of 10:00am to 7:00pm.  The Humboldt County Growers Alliance and others have requested that a consistent alignment be adopted allowing for the expansion of business hours of dispensaries in Humboldt County.
