Recommendation
That the Board of Supervisors:
1. Receive the staff report, and
2. Adopt the Resolution approving the appeal and approving the Conditional Use Permit for 12,650 square feet of commercial cannabis cultivation.

DISCUSSION:
On January 12, 2021 the Board of Supervisors held a duly-noticed public hearing to consider the application and appeal of the Planning Commission's approval of the Mattole River Farms, LLC Conditional Use Permit. The Board heard testimony from the public who stated that no cannabis cultivation likely occurred in previously in the former orchard, and from former landowners and workers who stated that cultivation was occurring in the orchard at the same time as the cultivation was occurring in the upper flat area. As a result of the testimony the Board felt that sufficient evidence supported that up to 1,250 square feet of cannabis may have been occurring within the orchard at the same time as the cultivation occurring on the upper flat, leading to a total of 12,650 square feet that could be approved, of which 7,850 square feet is outdoor and 4,800 square feet is mixed-light.

The Board closed the public hearing and discussed their intent to approve the Conditional Use Permit for a total of 12,650 square feet, and approved a motion to continue the project to the January 26, 2021 consent agenda in order to review and adopt a revised Resolution approving a total of 12,650 square feet of commercial cannabis.
