RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Authorize the Chair to sign the letter of support for ACA 5 legislation that would allow voters to reconsider repealing Prop. 209.

DISCUSSION:

In 1996, Voters approved Proposition 209, which prohibits the state from discriminating against or granting preferential treatment to any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting. Because it is a voter-approved proposition, it is difficult to amend without seeking voter approval for changes made.

 

ACA 5 would allow voters in California to reconsider Proposition 209.  If it passes the legislature with a 2/3rds vote in the next few weeks, it will be on the November ballot.

 

The intent of Proposition 209 was to end Affirmative Action in California in the hopes of promoting equal treatment.  However, the recent tragic murder of George Floyd and the international protests have once again put a spotlight on just how unequal treatment is of citizens in every aspect of life.
