RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Authorize the Chair to sign Resolution No. _______, the Governing Body Resolution (Attachment 1) for the DEA of the United States Department of Justice program DCE/SP and direct the Clerk of the Board to certify; and
2. Authorize the Sheriff, Undersheriff and the Deputy Director of Financial and Support Services to execute all the necessary applications, strategic plans, letters of agreements, amendments and reimbursement claims, in the name of the County of Humboldt, required by the Drug Enforcement Administration of the United States Department of Justice DCE/SP program; and
3. Authorize the Sheriff, Undersheriff and Deputy Director of Financial and Support Services to execute all the necessary contracts, agreements, and amendments thereto, in the name of the County of Humboldt, and all other documents required by the DEA of the United States Department of Justice DCE/SP program with approval from the County Administrative Office and County Counsel; and
4. Direct the Clerk of the Board to return a signed copy of the Governing Body Resolution to the Humboldt County Sheriff’s Office, Attention: Monika Fridley.

DISCUSSION:
Each year the DEA makes funding available to reimburse agencies for certain expenditures related to the eradication of black market cannabis in local jurisdictions. Last year HCSO received approval for $225,000.00 for the period of Oct. 1, 2021 to Sept. 30, 2022. We expect similar amounts awarded in subsequent years.
The funds will be spent for overtime of deputies or officers directly engaged in the black market cannabis eradication process, as well as some direct costs associated with the eradication and/or arrest of controlled substance violators. Examples of direct costs utilized by HCSO in the past include rental of aircraft, fuel for aircraft, and minor repairs and maintenance to support black market cannabis eradication.
FINANCIAL IMPACT:
Funds provided will be used for specified activities directly related to the black market cannabis eradication and controlled substance investigation and arrest. There is no grant match or additional general fund request for this program. Grant income and expenditures for county Fiscal Year 2022-23 were budgeted in 1100-221931 DCE/SP as part of the annual budget submission. HCSO will bring back a supplemental budget if necessary at a later date.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could deny the request to sign the Governing Body Resolution for the DCE/SP grant however, this is not recommended as these funds are integral to continuance of the county's black market cannabis control programs. In order to continue these programs without interruption the department would have to seek funding elsewhere or request additional monies from the general fund to cover overtime and other direct costs associated with the eradication program.
