RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Receive and file the bid proposals submitted for the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project;

2.                     Award the attached project agreement to GR Wilcox Enterprises, Inc., for the total amount of $706,541.66;

3.                     Authorize the Chair of the Board to execute the attached project agreement with GR Wilcox Enterprises, Inc., upon submittal of the appropriate bonds and insurance; and

4.                     Authorize the Public Works Director to execute contract change orders up to the amount of $47,827.

DISCUSSION:

On May 16, 2023, the Board of Supervisors authorized the Clerk of the Board to advertise the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project for bids. On June 13, 2023, the County of Humboldt received three (3) bids for the project, which are attached hereto as Attachment 1.

 

On reviewing the bid forms, Department of Public Works observed minor computational errors on GR Wilcox Enterprises, Inc.’s bid form, which have been reviewed and corrected in the attached construction agreement. 

 

The Department of Public Works recommends that the Board of Supervisors receive and file the bid proposals submitted for the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project; award the attached project agreement to GR Wilcox Enterprises, Inc., for the total amount of $706,541.66; authorize the Chair of the Board to execute the attached project agreement with GR Wilcox Enterprises, Inc., upon submittal of the appropriate bonds and insurance; and authorize the Public Works Director to execute contract change orders up to the amount of $47,827. This total price reflects the award of both the base bid and the additive option.

Narrative Explanation of Financial Impact:

The Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project is being funded by Federal Emergency Management Agency (FEMA) Disaster Recovery Funds (75%), California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%). The total project cost is estimated at $883,195. The Humboldt County Road Fund will be responsible for $55,199.69 of the total costs associated with the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project. Expenditure appropriations relating to completion of the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project are included in the adopted fiscal year (FY) 2023-24 Road Fund Budget (1200321-8940).

 

Projects are paid in arrears with anticipated funding coming from FEMA as mentioned above. The FY 2021-22 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $8.8 million in the county’s Road Fund. Even after allocating nearly $6.8 million of American Rescue Plan Act (ARPA) funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately $11 million.

 

This negative balance is partially due to the timing of FEMA reimbursements to the county, which can take years for the county to receive repayment. The current total of outstanding repayments is approximately $11.5 million. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects. Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

Narrative Explanation of Staffing Impact:

Awarding the project agreement for the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to award the Telegraph Creek Road (4A150) Post Mile 1.20 Storm Damage Repair Project to GR Wilcox Enterprises, Inc. However, this alternative is not recommended because the project will replace the failed culvert and restore the roadway using funds that would not otherwise be available to the County of Humboldt
