DISCUSSION:

Staff recommends that the Board adopt the attached resolution which authorizes the Humboldt County Department of Public Works’ Director, or a designee, to apply for, and if awarded, accept and administer funding made available through the CalRecycle funding for SB 1383Local Assistance Grant Program.

The county has made the investment of time and funds to comply with the guidelines set in place by SB 1383. These grant funds will help keep the county in compliance with SB 1383. SB1383 is aimed at reducing methane-producing organic waste in landfills by reducing organic waste disposal 75% by 2025 and rescuing for people to eat at least 20% of currently disposed surplus food by 2025.

Jurisdictions that do not meet the requirements of this state law are subject to fines of $10,000 per day. The county submitted a Notification of Intent to Comply with the requirements of SB1383 and SB 619, to CalRecycle in February of 2021. With participating jurisdictions and Humboldt Waste Management Authority, the county has taken steps to remain in compliance, including preparing the SB-1383 Road Map to offer regional compatibility and guidance and a professional services agreement with Abound Food Care, to assist the county and all participating jurisdictions in developing, implementing, and managing edible food recovery program tasks and actions required by state law.

FINANCIAL IMPACT:

Narrative Explanation of Financial Impact:

This CalRecycle Grant Program award will provide much-needed revenue to supplement the funds that the county is already investing in SB 1383 compliance. A supplemental budget will be brought to the Board for approval when the grant agreement is executed into the fiscal year 2023-24 for Public Works Solid Waste (3691-438). There will be no impact on the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to adopt the attached resolution authorizing the Humboldt County Department of Public Works Director, or a designee thereof, to apply for, and if awarded, accept and administer funding made available through CalRecycle. However, this alternative is not recommended because these funds will assist the county in staying in compliance with the guidelines of SB 1383.
