Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached agreement with the Del Norte County Probation Department regarding the placement of juvenile court wards from Del Norte County in the Humboldt County Juvenile Hall in the amount of $115 per ward, per day not to exceed a total of $300,000 for the period of February 2023 through June 30, 2025;
2. Authorize the Chief Probation Officer to execute any and all subsequent amendments to the attached agreement with Del Norte County Probation Department, after review and approval by County Counsel, Risk Management and the County Administrative Office;
3. Direct the Clerk of the Board to return one fully executed original copy of the attached agreement with Del Norte County Probation Department to: Ellisha Hardison, Legal Office Business Manager for Humboldt County Probation, for further processing.

SOURCE OF FUNDING:
Del Norte County Probation (Miscellaneous revenue 1100234-707010). This revenue is expected to offset any expenses relating to the detention of these juvenile wards.
DISCUSSION:
Del Norte County Probation Department is closing their Juvenile Hall and seeking to enter into an agreement with Humboldt County Probation for the placement of juvenile court wards pursuant to Welfare and Institutions Code § 870 and Government Code 6500 et seq. Under this agreement, Humboldt County shall be able to exercise all powers necessary to operate a Juvenile Hall which are vested in the County of Del Norte and the Del Norte County Probation Department pursuant to Welfare and Institutions Code § 850 et seq. The Humboldt County Probation Department currently operates a juvenile hall comprised of a 30-bed secure detention facility for youth who come under the jurisdiction of the juvenile court as well as the New Horizons program. New Horizons is a 6-month detention program operated in conjunction with the Department of Health and Human Services. Participants are provided a wide array of mental health, substance use disorder, and cognitive behavioral treatment services. This budget unit further contains the Secure Youth Treatment Program (SYTP) for court ordered youth who have been adjudicated for an offense listed in 707(b) of the Welfare and Institutions Code.
Accordingly, the Humboldt County Probation Department recommends that the Board of Supervisors approve, and authorize the Chair to execute, the attached agreement with Del Norte County Probation Department regarding the provision of placement for juvenile wards for the period of February 2023 through June 30, 2025. Staff also recommends that the Board authorize the Chief Probation Officer to execute any and all subsequent amendments to the attached agreement with the Del Norte County Probation Department, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed placement of juvenile wards coming from Del Norte County.
FINANCIAL IMPACT:
The attached agreement with Del Norte County Probation has a total payable of $300,000 for the period of February 2023 through June 30,2025. However, in the event local, state or federal funding is reduced or eliminated, either county may reduce the above-referenced maximum amount payable or terminate the attached agreement.
Expenditure appropriations related to the attached agreement have been included in the adopted FY 2022-23 budget for the Probation, Juvenile Hall and budget unit 234 (1100-234). The number of placed youth is anticipated to be small and the related expenses low enough to be able to absorb into the existing budget. Revenues to offset these costs will also come from Del Norte County Probation at a rate of $115 per day, per youth. As a result, approval of the agreement with the Del Norte County Probation Department will not impact the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the agreement or allow the Chair to sign such agreements, however this alternative is not recommended as Del Norte County Probation is closing their juvenile hall and accepting placement of juvenile court wards from Del Norte builds regional cooperation and provides a much needed service.
