RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receives and accepts the recommended contract amendment to the executed agreement with Nichols, Melburg & Rossetto Architects, Inc. (NMR) for architectural design and project management services for the Americans with Disabilities Act Compliance Project;
2. Authorize the Purchasing Agent to execute the amendment to the professional services agreement with NMR to provide consulting services for construction projects related to the Americans with Disabilities Act Compliance Project; and
3. Increase the maximum amount payable by county for services rendered, and expenses incurred, pursuant to the terms and conditions of project specific task orders issued under the original agreement from a maximum of Five Hundred Thousand Dollars ($500,000.00) to a maximum of Seven Hundred Thousand Dollars ($700,000.00).

DISCUSSION:
Humboldt County entered into a Consent Decree with the United States Department of Justice on September 13, 2016, to bring county facilities into compliance with Americans with Disabilities Act of 1990 (ADA) standards by September 13, 2019.
On April 3, 2017, the County Administrative Office advertised and distributed a Request for Qualifications (RFQ) for architectural design and project management services to retain experienced and qualified consulting firms to provide on-call architectural design and project management services to assist the county with the Humboldt County Americans with Disabilities Act Compliance Project. The RFQ solicitation yielded four (4) formal responses from a variety of design firms. Following the May 8, 2017, submission deadline, all consultant submissions were evaluated for meeting, at a minimum, specified professional credentials and experience.
On May 23, 2017, your Board received and accepted the recommended pre-qualification list for architectural design and project management services for Americans with Disabilities Act Compliance Project and authorized the Purchasing Agent to execute professional services agreements with the pre-qualified architectural design firms regarding the provision of consulting services. NMR was one of the four firms selected.
On August 28, 2018, your Board received and approved an increase to NMR’s contract maximum amount from Two Hundred Thousand Dollars ($200,000.00) to Five Hundred Thousand Dollars ($500,000.00) and approved an increase in the contract amount from Two Hundred Thousand Dollars ($200,000.00) to Four Hundred Thousand Dollars ($400,000.00) for The KPA Group, Sally Swanson Architects, Inc., and Brokaw Design. There is a need to increase the contract amount for NMR in order to task NMR with additional architectural design and construction management services necessary to fulfil the requirements set forth in the Consent Decree.
Your Board’s acceptance of the recommended amendment to the agreement with NMR will allow the county to continue architectural design and project management services in its correctional facilities such as the shower project, and detailed consent decree barriers in the Humboldt County Correctional Facility, and detailed consent decree barrier removal at the Regional Facility and Probation Main.
FINANCIAL IMPACT:
The cost of the architectural design and project management services have been included in the ADA Compliance budget for Fiscal Year 2018-19. The total cost to increase the architectural, design, and project management is Two Hundred Thousand Dollars ($200,000.00).

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board may choose to not authorize the amendment to the professional service agreements. This is not recommended as it would impede ADA project work and may subject the county to fines, penalties and sanctions from the Department of Justice.
