RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached eighth amendment to the northern solid waste container site operation and hauling agreement with Humboldt Sanitation Company, Inc.;
2. Approve, and authorize the Chair of the Board to execute, the attached tenth amendment to the southern solid waste container site operation agreement with Recology Eel River;
3. Approve, and authorize the Chair of the Board to execute, the attached ninth amendment to the Redway Transfer Station operation and maintenance agreement with Recology Eel River; and
4. Direct the Clerk of the Board to return two fully executed original copies of each attached amendment to the Department of Public Works Department for further processing.

DISCUSSION:
The reimbursement rates for the solid waste container sites and transfer station located in Humboldt County are calculated each year by adding the annual index-based adjustments, as set forth in the county’s solid waste container site agreements, plus any changes in the operators’ disposal, processing and operation costs. The reimbursement rate adjustments for the solid waste container sites and transfer station located in Humboldt County for fiscal year 2019-20 are as follows:
• Humboldt Sanitation Company, Inc. - Northern Container Sites: Reimbursement rate adjustment will result in an increase of $284.88 or less than 2% from the prior year’s reimbursement of $20.347.74.
• Recology Eel River - Southern Container Sites: Reimbursement rate adjustment will result in an increase of $817.96 or 8% from the prior year’s reimbursement of $9,202.94.
• Recology Eel River - Redway Transfer Station: Reimbursement rate adjustment will result in an increase of $1,732.65 or 14% from the prior year’s reimbursement of $11,619.08.
The attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation, Inc. and Recology Eel River will effectuate the above-referenced reimbursement rate adjustments as of July 1, 2019. In addition, the attached tenth amendment to the southern solid waste container site operation agreement with Recology Eel River will extend the term thereof for an additional 5 years, to June 30, 2024.
Section 521-6(c) of the Humboldt County Code provides that agreements for the collection of solid waste and/or source-separated recyclable materials may be extended or renewed for additional terms of up to 5 years, without a public hearing, if the Board of Supervisors determines that the public health, safety and well-being require such an extension or renewal. The proposed extension of the southern solid waste container site operation agreement with Recology Eel River will protect public health by ensuring that all residential, commercial and industrial solid wastes are stored, transported, transferred, processed and disposed of in a safe, sanitary and environmentally acceptable manner. Unsanitary conditions resulting from an accumulation of solid wastes can cause epidemic outbreaks, diseases, intolerable odors and waterborne diseases.
Accordingly, the Department of Public Works recommends that the Board approve, and authorize the Chair of the Board to execute, the attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation, Inc. and Recology Eel River.
FINANCIAL IMPACT:
Increasing the reimbursement rates will have no effect on revenues for the Solid Waste Disposal budget unit (1100-438), which administers the transfer station agreements.
The costs associated with the operation and maintenance of the solid waste container sites and transfer station located in Humboldt County, including recycling and illegal dumping clean-up, is projected to be approximately $528,063 for fiscal year 2019-20. Expenditure appropriations related to the operation and maintenance of the solid waste container sites and transfer station located in Humboldt County have been included in the proposed fiscal year 2019-20 budget for Solid Waste Disposal budget unit 1100-438.

The recommended actions support the Board of Supervisors’ Strategic Framework by providing community-appropriate levels of service.
