RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receive and file the bids for construction of the Garberville Public Health ADA Modification Project 2020-602;
2. Award the project to the lowest responsible and responsive bidder, Adams Commercial General Contracting, Inc.;
3. Authorize the Purchasing Agent to sign the construction agreement with Adams Commercial General Contracting, Inc., in the form of the attached sample agreement subject to approval from County Counsel and Risk Management; and
4. Authorize the Purchasing Agent to sign any and all amendments to this agreement after approval from County Council.

DISCUSSION:
On Sept. 7, 2016, the county entered into a Consent Decree with the United States Department of Justice (DOJ) that required the commencement of the Humboldt County Americans with Disabilities Act Compliance Project. The purpose of the Humboldt County Americans with Disabilities Act Compliance Project is to bring all county-owned and leased facilities that provide programs, services, and activities to the public into compliance with the Americans with Disabilities Act (ADA). The Garberville Public Health ADA Modification Project is part of this compliance effort.
On July 29, 2020, the County of Humboldt entered into a consultant services agreement with Alameida Architecture (AA) to design ADA improvements for the Garberville Public Health Branch. The construction project will renovate and remove barriers to access in the single user restrooms making one fully ADA compliant, reconstruct three service counters, replace the entrance door, and reconstruct the parking lot with one ADA accessible van parking stall and a compliant path of travel linking the facility to the pedestrian right of way as well as the newly constructed Garberville County Complex across the street. Staff worked with Public Works, Department of Health and Human Services, and AA in the review and development of the project’s plans and timeline.
On Oct. 19, 2021, your Board authorized the Garberville Public Health ADA Modification Project to be advertised for public bid. On Nov. 16, 2021, the county received and opened three (3) responsive bids and the results are as follows:

Staples Construction - Ventura, California $229,750
Sequoia Construction Specialties. - Eureka, California $270,200
The general conditions set forth in the project specifications manual require that the project be awarded on the merits of the lowest qualified, responsible, and responsive base bid. Staff recommends that your Board award this project to Adams Commercial General Contracting, Inc.- Eureka, California for the total base bid award amount of $187,950.
FINANCIAL IMPACT:
Current project expenses combined with contingencies and the Adams Commercial General Contracting, Inc. base bid amount of $187,950, establishes an estimated project cost of $269,500. The ADA Compliance budget (3552-152) has budgeted sufficient funds for the Garberville Public Health ADA Modification Project in the fiscal year 2021-22 budget.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to approve the recommendations to award the project however, this is not recommended as the Garberville Public Health Branch is a facility identified by the DOJ with ADA barriers that must be removed.
