RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018 regarding the provision of Medicare cost reporting services for the period of Oct. 23, 2018 through June 30, 2025;
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one fully executed original copy of the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018 to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
The Humboldt County Department of Health and Human Services - Behavioral Health (DHHS - Behavioral Health) is required to submit a Medicare Cost Report for inpatient services provided at the County of Humboldt’s Psychiatric Health Facility on an annual basis. All Medicare Cost Reports submitted by DHHS - Behavioral Health are subject to desk review or audit which may result in a suspension of payments or adjustment to Medicare reimbursements received if errors are found.
Medicare Cost Report filing requires specialized accounting knowledge for compliance with federal Centers for Medicaid Services reporting requirements. David S. Kornblum and Associates has demonstrated the ability to provide consultation, advisement, technical assistance and support services related to the preparation of annual Medicare Cost Reports over the past 20 years.
The attached third amendment to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018 will extend the term thereof, increase the maximum amount payable thereunder and modify the rates of compensation set forth therein in order to ensure the continued provision of needed Medicare cost reporting services.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018 regarding the provision of Medicare cost reporting services for the period of Oct. 23, 2018 through June 30, 2025. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with David S. Kornblum and Associates dated October 23, 2018, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed Medicare cost reporting services.
FINANCIAL IMPACT:
The attached third amendment to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018 will increase the maximum amount payable thereunder from $57,500 for the period of Oct. 23, 2018 through June 30, 2023 to $82,100 for the period of Oct. 23, 2018 through June 30, 2025.
Expenditure appropriations related to the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated Oct. 23, 2018 have been included in approved fiscal year 2022-2023 budget for DHHS - Behavioral Health Administration budget unit 1170-424. Funding for the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated October 23, 2018 is available through federal financial participation and state realignment revenues received by DHHS - Behavioral Health.
STAFFING IMPACT:
There are no staffing impacts associated with the approval of the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated October 23, 2018.

The recommended actions support the Board of Supervisors’ Strategic Framework by managing our resources to ensure sustainability of services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached third amendment to the professional services agreement with David S. Kornblum and Associates dated October 23, 2018. However, this alternative is not recommended since DHHS - Behavioral Health does not have qualified staff to perform the services needed to ensure accurate Medicare cost reporting.
