RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Accept the completed contract, including all change orders approved by the Public Works Department, between Mercer-Fraser Company and Humboldt County for construction of the East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10 and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Project; and

2.                     Approve the final claims for payment, to be submitted by the Public Works Department to the Auditor-Controller, in the amounts of Nine Hundred Eighty-Five Dollars ($985) for East Branch Road (6B175) Post Mile 0.36, Nine Hundred Eighty-Five Dollars ($985) for Oakcrest Drive (6B185) Post Mile 0.10, and Four Hundred Ninety-Two Dollars and Fifty Cents ($492.50) for Mosswood Lane (6B178) Post Mile 0.15, which will bring the total amounts paid to 100% of the contracts.

DISCUSSION:

On Feb. 14, 2017, the Federal Emergency Management Agency declared a disaster for Humboldt County due to severe winter storms, flooding, and mudslides. East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10 and Mosswood Lane (6B178) Post Mile 0.15; located in the Benbow area of Humboldt County, experienced roadway failures due to saturated embankment soils slipping beneath the roadway. The embankment failures resulted in lane closures and additional hazards to the small rural community of Benbow.

 

On Apr. 16, 2018 and May 21, 2018, the Humboldt County Department of Public Works (“Public Works”) received approval from the Federal Emergency Management Agency to proceed with the East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10 and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Projects.  Public Works prepared plans and specifications based on topographic surveys of the damaged areas prepared by Points West Surveying Company and Public Works, geotechnical studies prepared by Crawford and Associates, and design engineering reports prepared by GHD and Public Works.  The work consisted of constructing rock slope buttress, reinforcing embankments with geosynthetic material, installing surface and subsurface drainage facilities, restoring the road surfaces to pre-disaster conditions with aggregate base and hot mix asphalt, and installing sediment and erosion control items.

On June 2, 2020, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10, and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Projects for bids. On June 30, 2020, the County of Humboldt received five (5) bids for the projects. The contracts were awarded to Mercer-Fraser Company, the lowest responsible bidder, on July 28, 2020. The award amount was Two Million Forty-One Thousand Four Hundred Forty Dollars and Fifty Cents ($2,041,440.50), and contract change orders executed during the project increased the authorized amount by Thirty-Two Thousand Eight Hundred Twenty-Nine Dollars ($32,829) for Contract Number 217516 [East Branch Road (6B175) Post Mile 0.36] and decreased the authorized amounts by Twelve Thousand Seven Hundred Eighteen Dollars and Forty-Nine Cents ($12,718.49) for Contract Number 217518 [Oakcrest Drive (6B185) Post Mile 0.10] and by Eight Thousand One Hundred Forty-Six Dollars and Forty Cents ($8,146.40) for Contract Number 217341 [Mosswood Lane (6B178) Post Mile 0.15].

 

Public Works recommends that the Board of Supervisors accept the completed contracts, including all change orders approved by Public Works for this project, and approve the final claims for payment.

 

FINANCIAL IMPACT:

Total construction costs for this project are Two Million Fifty-Three Thousand Four Hundred Four Dollars and Sixty-One Cents ($2,053,404.61). Progress payments totaling One Million Six Hundred Thirty Thousand Seven Hundred Ten Dollars ($1,630,710) have been paid for the East Branch Road (6B175) Post Mile 0.36 Storm Damage Repair Project, and the final claim for payment in the amount of Nine Hundred Eighty-Five Dollars ($985) is outstanding. Progress payments totaling Three Hundred Forty-Four Thousand Nine Hundred Fourteen Dollars and Fifty-One Cents ($344,914.51) have been paid for the Oakcrest Drive (6B185) Post Mile 0.10 Storm Damage Repair Project, and the final claim for payment in the amount of Nine Hundred Eighty-Five Dollars ($985) is outstanding. Progress payments totaling Seventy-Five Thousand Three Hundred Seventeen Dollars and Sixty Cents ($75,317.60) have been paid for the Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Project, and the final claim for payment in the amount of Four Hundred Ninety-Two Dollars and Fifty Cents ($492.50) is outstanding.

 

The East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10, and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Projects are funded by Federal Emergency Management Agency Disaster Funds (75%), the California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%).

 

Expenditure appropriations relating to completion of the East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10, and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Projects are included in the approved fiscal year 2021-22 budget for Road Fund budget unit 321-2118. As a result, completion of the East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10, and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Project will not impact the Humboldt County General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to accept the East Branch Road (6B175) Post Mile 0.36, Oakcrest Drive (6B185) Post Mile 0.10, and Mosswood Lane (6B178) Post Mile 0.15 Storm Damage Repair Projects. However, staff does not recommend this alternative because the projects have been completed, and the requested Board actions are needed to accept the contract.
