RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Direct the Registrar of Voters to conduct the general municipal election and special elections for the City of Arcata;

2.                     Consolidate these elections with the General Election to be held on November 8, 2022;

3.                     Direct City of Arcata to reimburse the County of Humboldt for costs incurred; and

4.                     Request the Clerk of the Board to forward the signed Board Order and copy of City of Arcata Resolution No. 212-72 and Resolution No. 212-67 to the Humboldt County Office of Elections.

DISCUSSION:

On May 18, 2022, the Arcata City Council passed Resolution 212-67, to place a Utility Users Tax Measure on the November 8, 2022, ballot.  On June 22, 2022, the Council passed Resolution No. 212-72 for the purpose of electing certain officers and to submit to the electors a second measure which would place the Earth flag at the top of all City-owned flagpoles.  The City of Arcata is requesting consolidation with the General Election to be held on November 8, 2022, pursuant to Elections Code, Section 10403 and agrees to reimburse the County of Humboldt for all costs associated with the consolidated election.

 

Pursuant to Resolution No. 212-67, and Resolution 212-72, the first question to be submitted to the voters shall read:

 

“Shall the City of Arcata continue to impose a three percent (3%) utility users tax on the ordinary use of utility services in the City, including gas, electric, water, wastewater, and communications services; and, continue to impose an electricity users tax at the rate of 45% on residential customers whose electricity usage exceeds 600% over the established Baseline Allowance with a sole exemption for households receiving an extended Medical Baseline from the electricity service supplier; automatically terminating in 14 years on November 30, 2036?”

 

Pursuant to Resolution No. 212-67 and 212-72, the second question to be submitted to the voters shall read:

 

“Shall the City of Arcata enact the proposed ordinance entitled:  Initiative to Enact Ordinance Requiring That Earth Flag Is Flown at Top of Flagpole?  If adopted, this initiative would require the City of Arcata to fly the “Earth flag” above all other flags, including the official flags of the United States of America and the State of California, at the top of all City-owned flagpoles.”

 

FINANCIAL IMPACT:

Election consolidation will ultimately not impact the General Fund.  All funds advanced by the General Fund will be fully reimbursed by the City of Arcata.

This action supports your Board’s Strategic Framework by providing community-appropriate levels of service and building interjurisdictional and regional cooperation.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Your board could choose not to approve election consolidation with the General Election.  This is not recommended as this request is compliant with Elections Code Section 10403.  Additionally, not consolidating the election would require the Office of Elections to conduct multiple elections simultaneously, increasing costs to both the county and City of Arcata.
