RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve the attached plans and specifications for the Storm Damage Repair on Nancy Court (3J428) at Post Mile 0.08 Project;

2.                     Accept Public Work’s determination that the project is exempt from California Environmental Quality Act (CEQA) Guidelines pursuant to California Code of Regulations, Title 14, Division 6, Chapter 3, Section 15302 - "Replacement or Reconstruction" and 15269(a) - "Emergency Projects"; and

3.                     Direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code, with bids to be opened on Tuesday, Sept. 10, 2024, at 2:00 p.m.

DISCUSSION:

On Feb. 2, 2024, the Governor of California declared a disaster for Humboldt County due to the late Dec. 2023 through early Jan. 2024 winter storms. These winter storms caused widespread river and coastal flooding, flash flooding, high surf conditions, mudslides and debris flows that resulted in significant damage to roadways, public and private properties. Nancy Court (3J428) Post Mile 0.08, located in the Pine Hill area of mid-Humboldt County experienced culvert failure and embankment failure due to erosion at a storm drain outlet within a public maintained drainage easement.

 

Public Work’s hired Miksis Services, Inc. to investigate the storm drainage system using a remote-controlled video camera.  MSI reported the culvert’s condition and damage locations that resulted in the sink hole and slope failure at the storm drain outlet.   Subsequently, Public Works developed the attached plans and specifications. The work proposed in the attached plans and specifications consists of installing a rock buttress at the culvert outlet, repairing the sink hole under the sidewalk, and then following one of two options:

 

Option A:  replace 140 feet of culvert, abandon existing culvert and repair asphalt and base; or Option B:  repair 30 feet of culvert and install a plastic liner the entire length of culvert. 

 

Public Works requests that bidders provide costs for the Base Bid plus Option A and Base Bid plus Option B.   The contract will be awarded to the lowest bidder by comparing the total of all items of the Base Bid plus Option A and the total of all items of the Base Bid plus Option B.

 

CEQA Analysis:

This project consists of the replacement and reconstruction of existing road infrastructure in the same location as it existed prior to being damaged.  The project has substantially the same purpose and capacity as the prior infrastructure.  Such work is considered exempt pursuant to California Code of Regulations, Title 14, Division 6, Chapter 3, Section 15302.  This exemption applies to projects that are the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

 

Additionally, the facilities being replaced and reconstructed suffered damage within the scope of the disaster declaration made by the Governor on Feb. 2, 2024. Such emergency work is considered exempt pursuant to California Code of Regulations, Title 14, Division 6, Chapter 3, Section 15269(a). This exemption applies to projects that maintain, repair, restore, demolish, or replace property or facilities damaged or destroyed as a result of a disaster in a disaster-stricken area in which a state of emergency has been proclaimed by the Governor pursuant to the California Emergency Services Act, commencing with Section 8550 of the Government Code. This includes projects that will remove, destroy, or significantly alter an historical resource when that resource represents an imminent threat to the public of bodily harm or of damage to adjacent property or when the project has received a determination by the State Office of Historic Preservation pursuant to Section 5028(b) of Public Resources Code.

 

In August. 2023, the Board of Supervisors adopted Resolution #23-118 that assigned specified functions in administering CEQA to the Department of Public Works pursuant to 14 CCR 15025.  As such, Public Works has determined the project is exempt from environmental review pursuant to Sections 15302 and 15269 of the CEQA Guidelines.

Narrative Explanation of Financial Impact:

There is no financial commitment until the Storm Damage Repair on Nancy Court (3J428) at Post Mile 0.08 project is s awarded.  This project is being funded by California Governor’s Office of Emergency Services fund (75%) and the Humboldt County Road Fund (25%).  The engineer’s cost estimate for contracted construction items Option A is $74,840.00 and Option B is $121,840.00.

 

Expenditure related to completion of the Storm Damage Repair on Nancy Court (3J428) at Post Mile 0.08 project Road-Engineering budget unit 1200-321 will come back to the board when project is awarded for a supplemental budget.

 

Projects are paid in arrears.  The FY 2022-23 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $6 million in the county’s Road Fund.  Even after allocating nearly $6.8 million of American Rescue Plan Act (ARPA) funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately $9.7 million.

 

This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment.  The current outstanding repayments are approximately $7.5 million.  The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects.  Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board of Supervisors may choose not to approve the attached plans and specifications for the Storm Damage Repair on Nancy Court (3J428) at Post Mile 0.08 project.  However, this alternative is not recommended because the project will repair damage done during a declared disaster and prevent further damage and claims from private landholders using funds that would not otherwise be available to the County of Humboldt.
