RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve Cooperative Agreement No. 26-0148-000-SA, known as the Nursery Inspection Program contract with the California Department of Food and Agriculture in the amount of $1,120 for the period of July 1, 2026 through June 30, 2027; and
2. Authorize the Chair to sign the original agreement, and direct the Clerk of the Board to return all signed copies to the Agricultural Commissioner’s office for further processing; and
3. Grant a waiver from the provisions of the Nuclear Free Ordinance.

DISCUSSION:
The Agricultural Commissioner’s office receives annual subventions from California Department of Food and Agriculture (CDFA) to offset the local cost of enforcing certain state-mandated programs. Cooperative Agreement No. 26-0148-000-SA through CDFA provides funding for Humboldt County’s Nursery Inspection Program. The Agriculture Department enforces laws and regulations pertaining to the production and sales of nursery stock, including but not limited to licensing requirements and nursery stock cleanliness standards. The county nursery inspection program is conducted in accordance with the state-county Nursery Inspection Program Memorandum of Understanding between CDFA and the California Agricultural Commissioner’s and Sealer’s Association (CACASA). The amount reimbursable under this agreement shall not exceed $1,210 based on 80.5 reimbursable acres as reported by Humboldt County.
In Humboldt County there are 57 licensed production nurseries producing a wide range of plants and plant products including but not limited to cut flowers, reforestation conifers, vegetable starts and ornamental plants.
The waiver from the provisions of the Nuclear Free Ordinance is requested since the State of California will not modify its cooperative agreements to accommodate local ordinances.
This agreement is before your Board after the start date due to delays in the contracting process with the State.

Narrative Explanation of Financial Impact:
Cooperative Agreement No. 26-0148-000-SA provides $1,210 for the Humboldt County Nursery Inspection Program. Payment is made in arrears to Humboldt County based on monthly invoices and upon meeting contractual requirements. This was anticipated in the FY 2026-27 adopted budget for the Agricultural Commissioner budget, 1100-261.
STAFFING IMPACT:
There is no impact on staffing as this is part of regular staff duties.

N/A
ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board may not choose to approve this agreement. However, that is not recommended as the county would not be reimbursed for work performed in the program.
