RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached state standard agreement with the Department of State Hospitals regarding remote interviews of state hospital referrals in the amount of a flat rate of $5,000 and $500 per interview for the period of July 1, 2021 through June 30, 2024;

2.                     Authorize the Sheriff, Correctional Captain, or Deputy Director of Sheriff’s Administration to execute any and all subsequent amendments to the attached state standard agreement with Department of State Hospitals after review and approval by County Counsel, Risk Management and the County Administrative Office;

3.                     Authorize the Sheriff, Correctional Captain, or Deputy Director of Sheriff’s Administration, to sign all 5 associated forms with the contract. (Attachments 3-7)

4.                     Direct the Clerk of the Board to return one fully executed original copy of the attached State Standard Agreement with Department of State Hospitals to the HCCF, Attn: Captain Duane Christian for further processing.

DISCUSSION:

The California state mental health hospital system is overcrowded. This causes inmates who have been deemed “incompetent to stand trial” to be placed on long waiting lists for a bed in the state hospital to restore their competence. The wait is sometimes in excess of 4-6 months. During the wait period their mental health condition may deteriorate because they are not currently able to get the proper treatment at HCCF.

 

In some cases, those individuals awaiting beds can also receive mental health treatment within the facility and become eligible for re-evaluation. This program will allow for remote assessments to be completed by the Department of State Hospitals. These assessments will be a valuable tool to either determine someone is competent and therefore able to complete the legal process or reinforce the need for them to get placed in a state hospital as soon as possible. This contract will allow for the county to be compensated for the staff time and resources associated with these assessments. Additionally, the contract will allow for set-up costs to establish the program.

 

Accordingly, the Humboldt County Correctional Facility recommends that the Board of Supervisors approve, and authorize the Chair of the Board to execute, the attached State Standard Agreement with Department of State Hospitals regarding the remote interviews of state hospital referrals for the period of July 1, 2021 through June 30, 2024. Staff also recommends that the Board authorize the Sheriff, Correctional Captain or Deputy Director of Sheriff’s Administration to execute any and all subsequent amendments to the attached State Standard Agreement with Department of State Hospitals, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed for these essential assessments.

 

FINANCIAL IMPACT:

The attached state standard agreement with DSH has a maximum revenue of $45,000 for the period of July 1, 2021 through June 30, 2024.

 

Revenue appropriations related to the attached agreement was not included in the proposed FY 2022-2023 budget for the Correctional Facility, budget unit 1100-243. If the contract is approved, the Correctional Facility will bring a supplemental budget to the Board in July of 2022 in the amount of $15,000 to help offset salary expenses for the facility for staff to provide these services. As a result, approval of the agreement with the DSH will not impact the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the agreement or allow the Chair of the Board to sign such agreements, however this alternative is not recommended as it will negatively impact those individuals who are incarcerated and awaiting a bed in the state hospital, but in some cases delaying their legal process and/or worsening their mental health condition.
