RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chief Probation Officer to execute, the attached agreement with the Trinity County regarding the placement of Juvenile Court wards in the Humboldt County Juvenile Hall at a cost of $115 per ward, per day, not to exceed $300,000 for the period of September 30, 2022, through September 30, 2025; and

2.                     Authorize the Chief Probation Officer to execute any and all subsequent amendments to the attached agreement with Trinity County, after review and approval by County Counsel, Risk Management and the County Administrative Office.

DISCUSSION:

Trinity County Probation does not operate a Juvenile Hall. Generally, their youth are placed in the care and custody of Tehama County. Due to the increased instances of fire in California over the past several years, Trinity County Chief Probation Department reached out inquiring about a mutual-aid style agreement in which Trinity County could divert youth to the Humboldt County Juvenile Hall if Tehama County Juvenile Hall was inaccessible due to fire or other natural

disaster.

 

Accordingly, the Humboldt County Probation Department recommends that the Board of Supervisors approve, and authorize the Chief Probation Officer to execute, the attached agreement with Trinity County Probation Department regarding the provision of emergency juvenile hall placements for the period of September 30, 2022, through September 29, 2025. Staff also recommends that the Board authorize the Chief Probation Officer to execute any and all subsequent amendments to the attached agreement with Trinity County Probation Department, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed emergency juvenile hall placement.

 

FINANCIAL IMPACT:

The attached agreement with Trinity County Probation Department has a total payable of up to $300,000 for the period of September 30, 2022, to September 29, 2025, for the placement of Trinity County youth in the Humboldt County Juvenile Hall. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached agreement with Trinity County Probation Department.

 

Trinity County Probation Department will reimburse Humboldt County Probation $115 per day, per ward. Revenue and Expenditure appropriations related to the attached agreement were not included in the approved Fiscal Year (FY) 2022-23 for the Probation, Juvenile Hall budget unit 1100234. This agreement is only in place in case of emergency, and it is not anticipated that it will be utilized in FY 2022-23, therefore, no supplemental budget is requested. In the event it is necessary to utilize this agreement in future fiscal years, the Probation Department will bring a supplemental budget before the Board at that time.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the agreement or allow the Chair to sign such agreements, however this alternative is not recommended as it will limit juvenile court ward placement options for both Trinity County and Humboldt County in the event of a disaster.
