That the Board of Supervisors:
1. Approve the Supplemental Budget for State of California Asset Forfeiture Funds to be used for gang and drug prevention programs (“Program”) for fund and budget unit number to be determined (Attachment 1) and authorize the Auditor Controller to make any technical corrections necessary to effectuate the Board’s direction (4/5 vote required).

DISCUSSION:
In California, money possessed by people involved in possessing drugs for sale or selling drugs may be confiscated and forfeited. California Health and Safety Code section 11489 provides that 15% of all money seized from drug dealers shall be distributed to help fund programs, “designed to combat drug abuse and divert gang activity, and shall whenever possible involve educators, parents, community-based organizations and local businesses, and uniformed law enforcement officers. Those programs that have been evaluated as successful shall be given priority.”
To improve transparency, the Humboldt County Sheriff’s Office (HCSO) has requested the Auditor-Controller’s Office create a separate fund and budget unit number for the State of California Asset Forfeiture 15% Prevention Program Fund (“Program Fund”). 15% of all state asset forfeiture revenues received by the Drug Task Force (DTF) or HCSO will be separately accounted for in the Program Fund.
As outlined in the Health and Safety Code, a panel consisting of the Sheriff, a Police Chief, the District Attorney and Chief Probation Officer will evaluate requests and determine the distribution of funds. A supplemental budget is needed to account for the Program payments. As of the date of this agenda item the new fund and budget unit numbers have not been created and therefore the supplemental budget request states “To Be Determined” (TBD) in place of the fund and budget unit numbers.
FINANCIAL IMPACT:
DTF and the HCSO anticipates up to $50,000 will be available in FY2021-22 to fund programs in the community that meet the gang and drug abuse prevention criteria. There is no impact to the general fund.
