RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chief Probation Officer and Director of Health and Human Services, to execute, the attached Memorandum of Understanding (MOU) regarding the 1.0 FTE Mental Health Clinician for the Humboldt County Juvenile Hall, for the period of fiscal years 2022/23, through fiscal year 2025/26; and

2.                     Authorize the Chief Probation Officer and Director of Health and Human Services to execute any and all subsequent amendments to the attached MOU, after review and approval by County Counsel and the County Administrative Office.

Humboldt County Department of Juvenile Justice Realignment Allocation

 

DISCUSSION:

Per Senate Bill 823 commencing July 1, 2021, the responsibility for all youth adjudged a ward of the court will be shifted to county governments, for which the state will provide annual funding.

As of July 1, 2021, a youth shall not be committed to the department of Corrections and Rehabilitation, Department of Juvenile Justice (DJJ). Youth who would have previously been eligible for DJJ commitment will now remain under the care and custody of the local Probation Department.

 

Due to the local impacts of SB 823, California counties are required to create a Secure Youth Treatment Plan (SYTP) to ensure that the needs of this new population of youth are being met.

One such identified need is the addition of 1.0 FTE Mental Health Clinician in the Juvenile Hall.

 

Accordingly, the Humboldt County Probation Department recommends that the Board of Supervisors approve and authorize the Chief Probation Officer and Director of Health and Human Services, to execute, the attached Memorandum of Understanding with regarding the provision of 1.0 FTE Mental Health Clinician for the period of fiscal years 2022/23 - 2025/26. Staff also recommends that the Board authorize the Chief Probation Officer and Director of the Department of Health and Human Services, to execute any and all subsequent amendments to the attached MOU, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed mental health services in the Humboldt County Juvenile Hall.

 

FINANCIAL IMPACT:

The attached MOU will allow the Probation Department to reimburse the Humboldt County Department of Health and Human Services (DHHS) the cost of providing 1.0 FTE Mental Health Clinician, a total payable of up to $155,681, for the period of July 1, 2022, to June 30, 2023. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached MOU with DHHS.

 

Expenditure appropriations related to the attached agreement were included in the approved 2022/2023 fiscal year budget for the Probation, Juvenile Hall, DJJ Realignment, 1100-234002. These costs will be included in future annual budget cycles. Funding for the attached MOU with DHHS is available through Humboldt County’s DJJ Realignment allocation. As a result, approval of the agreement with the DHHS will not impact the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the agreement or allow the Chief Probation Officer and Director of Health and Human Services to sign such agreements, however this alternative is not recommended as it will prevent youth from receiving needed mental health services while in the care and custody of Humboldt County Juvenile Hall.
