RECOMMENDATION(S):

Recommendation

That the Board of Supervisors approve the Agreement with California Department of Corrections and Rehabilitation - Division of Juvenile Justice Facilities for Diagnostic Studies, Treatment Services and Temporary Detention; execute the Board of Supervisors Resolution approving the Agreement; authorize the Interim Chief Probation Officer to execute the Agreement and other documents associated with the Agreement; and direct the Clerk of the Board to return the Board of Supervisors Resolution to the County of Humboldt Probation Department, Attention: Ellisha Hardison.

DISCUSSION:

 

The Humboldt County Superior Court adjudicates many cases each year. Periodically, the Court must reach a disposition on a seriously disturbed juvenile/youthful offender. The case requires in-depth information and services that are available through the CDCR/DJJ diagnostic program. The CDCR/DJJ diagnostic study provides an evaluative social history, psychological testing, and psychiatric study, as indicated, in a CDCR/DJJ facility setting. Diagnostic evaluations are ordered by the court and must be completed with 90 days of CDCR/DJJ’s receipt of the offender.

 

Most often, a satisfactory diagnostic study can be performed locally by the Humboldt County Probation Department Juvenile Hall diagnostic program. However, on occasion, the CDCR/DJJ diagnostic tool is necessary for the adult and juvenile courts when reaching an appropriate disposition for serious youthful and delinquent offenders. Though not extensively used, the CDCR diagnostic program implements Sections 704 and 1731.6 of the California Welfare and Institutions Code. This Agreement was recently received from the California Department of Corrections and Rehabilitation, with the term scheduled to begin on July 1, 2018 and to end on June 30, 2020.

 

The Probation Department respectfully requests the Board of Supervisors’ approval of the resolution included with this report. CDCR/DJJ requires Board approval of a resolution if the county desires to enter into this agreement for diagnostic services.

 

FINANCIAL IMPACT:

 

The Agreement sets the daily amount at $223 for each case ordered for evaluation. The estimated cost for each year of the agreement is $73,590 for a maximum amount of $147,180 for the two years of the agreement. An appropriation has been set in the Probation Department’s budget to cover anticipated expenditures for fiscal year 2018-19. The Board’s approval of this Agreement and Resolution will allow the Probation Department to manage its resources to ensure the sustainability of necessary court-ordered services with no added impact to the County General Fund. This agreement supports the Board’s Strategic Framework through building interjurisdictional and regional cooperation.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

 

The Board may choose not to approve the agreement however this is not recommended. Should the Superior Court order a CDCR/DJJ diagnostic service for a juvenile ward, the Probation Department would be unable to comply with the order without a CDCR/DJJ agreement.
