RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve the Resolution approving subsequent Local Area Designation and Local Workforce Development Board Recertification request for Program Years 2019-2021 and authorize the Chair of the Board to sign the Recertification Application (Attachment 1);
2. Authorize and direct the Chair of the Board to sign the two (2) copies of the LWDB Recertification Request for Program Years 2019-2021 (Attachment 2); and
3. Direct the Clerk of the Board to return two (2) signed originals of the LWDB Recertification Request for Program Years 2019-2021 to the Economic Development Department for submission to the California Workforce Development Board.

DISCUSSION:
The federal Workforce Innovation Opportunity Act, P.L. 113-128, (WIOA) was signed into law on July 22, 2014, thus superseding the Workforce Investment Act (WIA) of 1998. The intent of WIOA is to provide workforce development activities through statewide and local systems that increase the employment, retention, and earnings of participants, and increase attainment of recognized credentials by participants.
In California, WIOA is administered by the California Employment Development Department (EDD). Humboldt County is the designated Local Workforce Innovation Area (LWIA) for this region of the state, administered by the Humboldt County Local Workforce Development Board (HC-LWDB). The Board of Supervisors is designated as the Chief Elected Official (CEO) for the HC-LWDB. In accordance with the WIOA and EDD Guidelines and Directives, each LWDB must be recertified by the Governor every three years. The HC-LWDB was last certified in 2016. As the CEO, your Board must approve and sign the LWDB Recertification Request for Program Years 2019-2021.
EDD establishes the procedures for the recertification of LWDBs under WIOA. The Local Board recertification that is requested will be effective July 1, 2019 through June 30, 2021. At its May 10, 2019 meeting, the Humboldt County Workforce Development Board (HC-WDB) approved the recommendation to send this item to the Board of Supervisors for its approval and the signature by the Chair of the Board. The HC-WDB is seeking Board approval as soon as practicable following the EDD Directive and HC-WDB approval.
This recertification ensures the continuation of the HC-WDB’s WIOA funding and operations in Humboldt County.
The process for recertification of Local Boards under WIOA is the responsibility of the State Board. In Accordance with WIOA Section 107, subdivision (c)(2) (codified at 29 U.S.C. section 3122, subs. (c)(2)), the State Board will recommend recertification so long as a Local Board:
*Continues to meet the membership provisions established in WIOA;
*Meets or exceeds performance accountability measures;
*Demonstrates sustained fiscal integrity; and
* Engages in the regional planning process.
The HC-WDB has met the requirements necessary for recertification. The completed Recertification Request must be signed by the Local Board (WDB Chair) and the local CEO and submitted to the State Board. An initial draft was submitted to the State Board this month, and the fully executed recertification will be submitted as soon as practicable following approval by the Board of Supervisors and signature by the Chair.
FINANCIAL IMPACT:
Should your Board approve and sign the Recertification Request, there would be no financial impact. If your Board should decide not to approve and sign the Recertification Request, the LWIA would be deemed ineligible to receive Title I program funds which would result in an estimated $606,900 for FY 2019-2020.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to accept these funds. This alternative is not recommended because declining these funds would make services unavailable to Humboldt County residents and employers.
