RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Director of Public Works to execute, the attached Contract Change Order Number 2 for Contract Number 217264 (Post Mile 11.98) for the total amount of $81,375 (4/5 Vote Required);

2.                     Accept the completed contracts, including all change orders approved by the Public Works Department, between Van Meter Logging, Inc., and Humboldt County for construction of Storm Damage Repair to Alderpoint Road (F6B165) Post Miles 9.45, 10.52, 11.94, and 11.98; and

3.                     Approve the final claims for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amounts of $138 for Post Mile 9.45, $314.96 for Post Mile 10.52, $254.50 for 11.94, and $81,375 for Post Mile 11.98, which will bring the total amounts paid to 100% of the contracts.

DISCUSSION:

On March 7, 2017, the Governor of the State of California declared a disaster for Humboldt County due to severe winter storms, flooding, and mudslides. Alderpoint Road (F6B165) Post Miles 9.45, 10.52, 11.94, and 11.98, located in the Garberville area of southern Humboldt County, experienced roadway settlement and shoulder failure. Emergency temporary repairs were performed at the time of the disaster to maintain essential traffic.

 

On Nov. 8 and Nov. 19, 2019, the Humboldt County Department of Public Works (Public Works) received funding approval from the Federal Highway Administration to proceed with the Alderpoint Road (F6B165) Post Miles 9.45, 10.52, 11.94, and 11.98 Storm Damage Repair Project.  Public Works prepared plans and specifications for the project based on topographic surveys of the damaged areas prepared by Points West Surveying Company and geotechnical studies prepared by Crawford and Associates. The work consisted of constructing welded wire retaining walls and reinforced embankment, installing subsurface drainage and storm drainage systems, restoring the roadway to original width, and installing sediment and erosion control measures.

 

On Jan. 5, 2021, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Alderpoint Road (F6B165) Post Miles 9.45, 10.52, 11.94, and 11.98 Storm Damage Repair Project for bids. On Feb. 2, 2021, the County of Humboldt received nine (9) bids for the project. The contracts were awarded to Van Meter Logging, Inc., the lowest responsible bidder, on March 2, 2021. The award amount was $634,675.65. Contract change orders executed during the project increased the authorized amounts of Contract Number 217261 (Post Mile 9.45) by $6,620, Contract Number 217262 (Post Mile 10.52) by 63,369.70, and Contract Number 217264 (Post Mile 11.98) by $79,144.40 and decreased the authorized amount of Contract Number 217263 (Post Mile 11.94) by $4,336.35. The increases are due to costs associated with replacing excavated material that was not suitable for backfill at Post Mile 9.45, repairing an existing culvert as recommended by the geotechnical engineer at Post Mile 10.52, and mitigation measures to repair and protect the roadway from damage due to continued ground movement at Post Mile 11.98.

 

Public Works recommends that the Board of Supervisors approve, and authorize the Director of Public Works to execute, Contract Change Order Number 2 for Post Mile 11.98; accept the completed contracts, including all change orders approved by Public Works for this project; and approve the final claims for payment.

 

FINANCIAL IMPACT:

Total construction costs for this project are $779,443.40. Progress payments totaling $41,319 have been paid for Post Mile 9.45, and the final claim for payment in the amount of $138 is outstanding.  Progress payments totaling $321,854.99 have been paid for Post Mile 10.52, and the final claim for payment in the amount of $314.96 is outstanding. Progress payments totaling $134,196.95 have been paid for Post Mile 11.94, and the final claim for payment in the amount of $254.50 is outstanding. Progress payments totaling $199,990 have been paid for Post Mile 11.98, and the final claim for payment in the amount of $81,375 is outstanding.

 

This project was funded through Federal Highway Administration (FHWA) Emergency Relief Funds (88.53 percent) and the Humboldt County Road Fund (11.47 percent). Expenditure appropriations relating to completion of the Alderpoint Road (F6B165) Post Miles 9.45, 10.52, 11.94, and 11.98 Storm Damage Repair Project are included in the approved Fiscal Year 2021-2022 Road Fund Budget; therefore, this project has no impact on the General Fund.

 

Projects are paid in arrears with anticipated funding coming from FHWA as mentioned above. The FY 2020-21 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $5.9 million. This negative balance is due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the 11.47% Humboldt County Road Fund match for FHWA projects.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to accept the project. However, staff does not recommend this alternative because the project has been completed, and the requested Board actions are needed to accept the contracts.
