RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1. Approve acceptance of the SCAAP Award for 2024 in the amount of $50,705; and

2. Authorize the Sheriff’s Deputy Director of Financial and Support Services to be the Authorized Representative for the county that accepts and signs all documents related to the SCAAP grant in the on-line Just Grants system (copy of the award documents to be signed on-line in Attachment 1); and

3. Approve the Supplemental Budget (Attachment 2) for budget unit 1100-243 in the amount of $22,705 (4/5 Vote Required); and

4.                     Authorize the Sheriff, Undersheriff or Sheriff’s Deputy Director of Financial and Support Services to sign all future amendments, terminations, extensions, and documents directly related to the FY 2024 State Criminal Alien Assistance Program upon review of County Counsel, Risk Management, and the County Administrative Office.

DISCUSSION:

Under the statutorily required State Criminal Alien Assistance Program, the Office of Justice Programs (OJP) of the U.S. Department of Justice (DOJ) makes payments to eligible states and units of local government that incur certain types of costs due to incarceration of undocumented criminal aliens during a particular 12-month report period. The reporting period for the FY 2024 program is July 1, 2022, through June 30, 2023.  The Humboldt County Sheriff’s Office (HCSO) has been participating in the program each year it has been offered since 2001.

 

HCSO routinely uses the funds award to off-set budgetary costs such as employee overtime to meet minimum staffing requirements.

Narrative Explanation of Financial Impact:

HCSO has been awarded the State Criminal Alien Assistance Program grant every year the grant has been available since 2001. This funding is offered through annual solicitations. Each year the HCSO has received between $3,500 to $51,000.  The FY 2024 grant award is $50,705. Due to the varying amount of the grant, $28,000 was budgeted in FY 2024-25 in budget unit 1100-243, therefore, a supplemental budget is requested in the amount of $22,705. There is no match requirement for this grant.

 

STAFFING IMPACT: Acceptance of this award does not have any staffing impact and allows for payment of necessary overtime.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Should the Board deny acceptance of the FY 2024 State Criminal Alien Assistance Program grant funds and supplemental budgets, then HCSO would need to forfeit the grant award.
