DISCUSSION:

On Nov. 5, 2024, California voters approved Proposition 36 which modifies provisions of Proposition 47 (2014) to increase accountability for certain drug and theft crimes.  A central pillar of Proposition 36 is the creation of a "treatment-mandated felony," a new legal process allowing prosecutors to charge individuals with a felony for drug possession if they have two or more prior drug-related convictions.  Individuals charged under this statutory framework will be offered the opportunity to complete court-ordered behavioral health treatment.  Successful completion of a treatment program will result in the dismissal of the charges, prioritizing a health-based resolution over incarceration for eligible participants.

The California State Legislature included a one-time allocation of funding in California Assembly Bill 102 in order to support the statewide implementation of Proposition 36 behavioral health requirements.  Such funding will allow counties to establish the necessary infrastructure to conduct behavioral health assessments, coordinate with the courts and deliver mandated behavioral health treatment services.  Sierra Health Foundation: Center for Health Program Management has contracted with the California Department of Health Care Services to administer the funding made available to counties through California Assembly Bill 102.

The attached subrecipient agreement with Sierra Health Foundation: Center for Health Program Management will allow the Humboldt County DHHS - Behavioral Health to receive up to $430,582.16 for the purpose of implementing Proposition 36 behavioral health requirements in Humboldt County for the period of March 1, 2026 through March 31, 2028.  It should be noted that the attached subrecipient agreement with Sierra Health Foundation: Center for Health Program Management comes to your Board after the start date thereof due to inadvertent delays that occurred during the contract development process.

Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached subrecipient agreement with Sierra Health Foundation: Center for Health Program Management regarding implementation of Proposition 36 behavioral health requirements in Humboldt County for the period of March 1, 2026 through March 31, 2028.  It is also recommended that your Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and other agreements, certifications, attestations, reports, writings and documents directly associated with, the attached subrecipient agreement with Sierra Health Foundation: Center for Health Program Management, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the implementation of Proposition 36 Behavioral Health requirements in Humboldt County.
