Recommendation
That the Board of Supervisors:
1. Authorize the Chair of the Board to sign the Amendment to the License Agreement between the County of Humboldt and Kelton J. Chambers; and
2. Authorize the Auditor-Controller to make a onetime payment to Licensor in the amount of $800 within 90 days of the executed agreement.

DISCUSSION:
On May 1, 2018, the Board of Supervisors approved a license agreement between the County of Humboldt and Kelton J. Chambers for stockpile purposes (Attachment 1). The proposed amendment (Attachment 2) to the License Agreement with Kelton J. Chambers is for the addition of Kaylee Chambers’ name on the agreement and a change in the compensation and payable date.
The current agreement states “Kelton J. Chambers, a married man as his sole and separate property”. The amendment shall be KELTON J. CHAMBERS and KAYLEE CHAMBERS, as their sole and separate property.
The current agreement states the compensation as “COUNTY shall pay monthly SITE rental payment in advance on an annual basis, at the sum of Six Hundred Dollars ($600) per year. Annual SITE rental payments shall be made payable before April 30 of each year”. The amendment shall be “COUNTY agrees to pay OWNERS a SITE rental fee of in advance on an annual basis, at the sum of One Thousand Dollars ($1,000) per year, starting with 2026-27 fiscal year. Annual SITE rental payments shall be made payable before August 1st of each year.” Additionally, “A onetime payment of $800 is due within 90 calendar days of the executed agreement.”

Narrative Explanation of Financial Impact:
The new license agreement provides for annual site rental payments of $1,000 payable on or before August 1 of each. This is an annual increase of $400 from the current agreement of $600 per year. A one-time payment of $800 is due within 90 calendar days of the executed agreement. There are sufficient funds available to cover the additional costs in the Roads Maintenance budget (1200325) which will bear the cost of all payments.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the Amendment to the License Agreement. However, this is not recommended as the current Public Works rate for stockpiles has been increased to $1,000. This amendment will make the agreement consistent with the current rate of payment for stockpile sites. In addition, strategically located stockpile sites are critical for the department to reduce hauling costs associated with routine projects as well as responding to disaster related damage to the road system. This allows the department to quickly re-open roads by having resources stockpiled in strategic locations.
