RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Waive the requirements of the Humboldt County Nuclear Free Ordinance with regard to the attached intergovernmental agreement with the California Department of Health Care Services (DHCS); and
2. Approve, and authorize the Department of Health and Human Services (DHHS) - Behavioral Health Director, or a designee thereof, to execute, the attached intergovernmental agreement with the DHCS regarding the provision of substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County for the period of July 1, 2025 through Dec. 31, 2026; and
3. Authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached intergovernmental agreement with the DHCS, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
4. Direct the Clerk of the Board to provide the DHHS - Contract Unit with one fully executed, certified copy of the Board Order related to this item for submission to the DHCS.

DISCUSSION:
In April 2020, the Humboldt County Board of Supervisors (Board) authorized the Humboldt County DHHS - Behavioral Health to opt into the Drug Medi-Cal Organized Delivery System (DMC-ODS) pilot project and approved the receipt of funding for the provision of covered DMC-ODS services within Humboldt County. The DMC-ODS pilot project allows California counties to dramatically expand, improve and reorganize its system for treating people with substance use disorder. Participation in the DMC-ODS pilot project requires counties to provide access to a full continuum of substance use disorder treatment services modeled after the American Society of Addiction Medicine criteria.
Partnership HealthPlan of California, the County of Humboldt, and six other Northern California counties submitted a DMC-ODS Implementation Plan, now known as the Wellness and Recovery Program, to identify and provide covered DMC-ODS services for each counties’ eligible Medi-Cal beneficiaries under the oversight of Partnership HealthPlan of California. In August 2021, DHHS - Behavioral Health entered into a memorandum of understanding (MOU) with Partnership HealthPlan of California which sets forth each party’s rights and responsibilities regarding participation in the Wellness and Recovery Program. This MOU specifically ensures that Partnership HealthPlan of California will provide oversight for compliance with DMC-ODS requirements and allows certified DMC-ODS providers to submit invoices for Drug Medi-Cal services to the DHCS through Partnership HealthPlan of California.
The attached intergovernmental agreement with the DHCS sets forth the terms, conditions, principles and general requirements that DHHS - Behavioral Health must comply with in order to receive DMC-ODS funding for the provision of substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County for the period of July 1, 2025 through Dec. 31, 2026. It should be noted that the attached intergovernmental agreement with the DHCS comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached intergovernmental agreement with the DHCS, regarding the provision of substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County for the period of July 1, 2025 through Dec. 31, 2026. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached intergovernmental agreement with the DHCS, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed substance use disorder services to eligible Medi-Cal beneficiaries residing in Humboldt County.

FINANCIAL IMPACT:
There is no maximum amount payable or direct financial obligation associated with the execution of the attached intergovernmental agreement with the DHCS. If approved the intergovernmental agreement authorizes DHHS - Behavioral Health to seek reimbursement for the provision of covered substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County for the period of July 1, 2025 through Dec. 31, 2026. Revenue and expenditure appropriations related to the eligible services covered under the attached intergovernmental agreement with the DHCS have been included in approved fiscal year 2025-26 budget for DHHS - Behavioral Health budget unit Substance Use Disorder (1180425).
STAFFING IMPACT:
The attached intergovernmental agreement with DHCS will not impact current staffing levels.
OTHER AGENCY INVOLVEMENT:
None
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached intergovernmental agreement with the DHCS regarding the provision of substance use disorder treatment services to eligible Medi-Cal beneficiaries residing in Humboldt County. However, this alternative is not recommended since it will not allow the County of Humboldt to provide the expanded substance use disorder treatment services authorized by the DMC-ODS Wellness and Recovery Program to eligible Medi-Cal beneficiaries residing in Humboldt County.
