Recommendation
That the Board of Supervisors:
1. Approve acceptance of the grant funds in the amount of $499,746 from the California Coastal Commission for the term of Aug. 15, 2023, through Nov. 15, 2025, to update and implement the Humboldt Bay Area Plan (HBAP); and
2. Approve the attached Supplemental Budget for budget unit 1100282-601; and
3. Authorize the Director of Planning and Building to enter into an agreement with LACO Associates to carry out the professional services necessary to update and implement the Humboldt Bay Area Plan including any amendments, following review and approval by County Counsel and Risk Management.

DISCUSSION:
This is a request to receive and use funds from a California Coastal Commission to update the Humboldt Bay Area Plan. In order to prioritize completion of the work and balance other long range planning work approval to use a consultant is also requested. There is allocation within the grant to fund the staff time needed to manage the consultant.
On Nov. 8, 2022, your Board authorized submittal of a grant application to the California Coastal Commission (CCC) to provide financial and planning assistance, under authority of the California Coastal Act, in an amount up to $100,000 to fund completion of the update to the Humboldt Bay Area Plan. On March 7, 2023, your Board authorized an increase in the amount of funding requested to $500,000 to complete this work.
The HBAP needs to be updated to address the amount of Coastal Dependent Industrial Land, inconsistencies in zoning, accurately describe and depict existing conditions and address ambiguities and conflicts in service areas, and Urban Limit Lines. The update will also implement the best available information related to Sea Level Rise and Tsunami run up.
Board approval is requested to authorize the Planning and Building Director to execute any agreements, contracts, and amendments necessary to carry out the goals of the CCC Grant Agreement. This will allow the Director of Planning and Building to enter into a Professional Services Agreement with LACO Associates to provide professional services in support of the update to the HBAP and Zoning Code (Attachment 2). LACO Associates has significant experience working on the Samoa Peninsula and around the bay region. LACO Associates developed an inventory of Coastal Dependent Industrial property for Humboldt Bay that assessed the existing development and the potential for new development on those properties and the principle at LACO was a lead in developing and processing the Samoa Town Master Plan.
FINANCIAL IMPACT:
Grant funding in the amount of $499,746 will designate $367,000 for professional services. The remaining $132,746 will be allocated to department staff costs to support the work of LACO Associates and bring the result to the Planning Commission and the Board of Supervisors for final approval.
STAFFING IMPACT:
LACO Associates will provide the majority of the work associated with the HBAP update. Existing staff will provide support with funding not allocated to LACO Associates.

This action supports your Board’s Strategic Framework priority of seeking outside funding sources to benefit Humboldt County needs; creating opportunities for improved safety and health, protecting vulnerable populations and facilitating public/private partnership to solve problems.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to accept these funds. This is not recommended as grand funds available for local coastal planning are scarce and there may only be limited opportunities to resubmit in the future. Your board could also choose not to authorize the Director to execute the professional services agreement with LACO Associates. This is not recommended as the vendor is well versed and able to provide the expertise necessary by the County.
