RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached third amendment to the consultant services agreement with Quincy Engineering, Inc., as assigned to Consor North America, Inc., regarding the provision of design engineering and environmental services for the Holmes-Larabee Bridge Project [Contract Number 594171]; and

2.                     Approve, and authorize the Chair of the Board to execute, the attached third amendment to the consultant services agreement with Quincy Engineering, Inc., as assigned to Consor North America, Inc., regarding the provision of design engineering and environmental services for the McCann Bridge Project [Contract Number 594172]; and

3.                     Direct the Clerk of the Board to return one (1) fully executed original copy of the attached third amendments to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., to the Engineering Division of the Department of Public Works for further processing.

DISCUSSION:

On March 14, 2017, the Humboldt County Department of Public Works (“Public Works”) issued a Request for Qualifications Number DWP2017-002 (“RFQ No. DWP2017-002”) for the purpose of selecting a qualified consultant team for the provision of design engineering and environmental services for both the Holmes-Larabee and McCann Bridge Projects.  County of Humboldt staff, in conjunction with the California Department of Transportation (“Caltrans”), conducted interviews of the six (6) consultant teams that submitted statements of qualifications in response to RFQ No. DWP2017-002 on June 6 and June 7, 2017.  The interview panel selected Quincy Engineering, Inc. as the most qualified team and began the contract negotiation process on June 16, 2017.

 

On April 24, 2018, the Board of Supervisors approved, and authorized the chair of the board to execute, consultant services agreements with Quincy Engineering, Inc. regarding the scope of services, project schedule and costs pertaining to the provision of design engineering and environmental services for both the Holmes-Larabee and McCann Bridge Projects.  The County of Humboldt also secured the necessary approvals from the Audits and Investigations and Local Assistance Divisions of Caltrans as required by the Caltrans Local Assistance Procedures Manual.

 

On February 28, 2023, the Board of Supervisors approved the first amendments to the consultant services agreements with Quincy Engineering, Inc. which assigned the obligations set forth therein to Consor North America, Inc.  The Board of Supervisors subsequently approved the second amendments to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., which modified the scope to include right-of-way consultant services, including, without limitation, obtaining rights of entry for five (5) properties, temporary construction easements, permanent easement acquisition and certification of right-of-way using procedures that meet federal funding requirements, on June 4, 2024.   

 

The attached third amendment to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., modify the scope of the consultant services provided thereunder to include additional right-of-way consultant services, including, without limitation, obtaining rights of entry for temporary access onto five (5) additional properties for the Holmes-Larabee Bridge Project and six (6) additional private properties for the McCann Bridge Project.   The rights of entry are necessary for environmental studies, planning and preliminary geotechnical investigation.

 

Initially, Public Works was going to perform all right-of-way services needed for the Holmes-Larabee and McCann Bridge Projects, however, due to difficulties in obtaining access and negotiating with landowners, Public Works is seeking additional right-of-way support.   Without the environmental and geotechnical studies needed to complete the preliminary engineering phase, Public Works cannot progress to the next phase of the Holmes-Larabee and McCann Bridge Projects. 

 

Accordingly, the Public Works recommends that the Board of Supervisors approve, and authorize the Chair of the Board to execute, the attached third amendments to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., regarding the provision of design engineering and environmental services agreement for Holmes-Larabee and McCann Bridge Projects.

*Projected amounts are estimates of the third amendment portion of the consultant services agreement and do not include already budgeted contract amounts and are subject to change.

 

The attached third amendment to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., increases the maximum amounts payable thereunder by Twenty-Two Thousand One Hundred Dollars ($22,100.00), for the provision of design engineering and environmental services related to the Holmes-Larabee Bridge Project, and Twenty-Six Thousand Seven Hundred Dollars ($26,700.00) for the provision of design engineering and environmental services related to the McCann Bridge Project.  The Holmes-Larabee and McCann Bridge Projects are being funded through the Federal Highway Administration’s Highway Bridge Program and Toll Credits, which will provide one hundred percent (100%) of the funding for both projects.   

 

The fiscal year 2023-2024 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of Seven Million Eight Hundred Thousand Dollars ($7,800,000) in the Humboldt County Road Fund.  Even after allocating nearly Six Million Eight Hundred Thousand Dollars ($6,800,000.00) of American Rescue Plan Act funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately Twelve Million Dollars ($12,000,000).

 

This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements, which can take years for the County of Humboldt to receive.  The current total of outstanding repayments is approximately Seven Million Five Hundred Thousand Dollars ($7,500,000).  Public Works utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects.  Despite the use of additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

 

 

STAFFING IMPACT:

Approval of the attached third amendments to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the attached third amendments to the consultant services agreements with Quincy Engineering, Inc., as assigned to Consor North America, Inc., regarding the provision of design engineering and environmental services for the Holmes-Larabee and McCann Bridge Projects.  However, this alternative is not recommended since the County of Humboldt has limited staff to perform the specialized right-of-way services required, and funding may be jeopardized if the projects cannot proceed to the construction phase in a timely manner.
