RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the MOU with Humboldt County Office of Education for the period of July 1, 2019 through June 30, 2021 to provide and coordinate Educational Support for County Foster Youth (Title IV-E Foster Care Administrative Activities);
2. Authorize the DHHS - CWS Director to amend program elements of the agreement as necessary after review and approval by County Counsel and Risk Management for the term of July 1, 2019 through June 30, 2021; and
3. Direct the Clerk of the Board to route the fully executed agreement to DHHS- Contract Unit for further processing.

DISCUSSION:
The MOU with Humboldt County Office of Education (HCOE) will provide educational support to pupils in foster care, as described in California Education Code Section 42921. HCOE will work together with DHHS-CWS and the Probation Department to ensure that there is no duplication of activities, minimize changes in school placement, facilitate prompt enrollment and transfer educational records, ensure transfers are done at an educationally appropriate time and ensure appropriate partial credits are awarded.
The services provided pursuant to the terms and conditions of this MOU, include, without limitation, sharing educational status and progress information required for inclusion in court reports by California Welfare and Institutions Code Section 16010, responding to information requests from the juvenile court, working with the juvenile court to ensure the delivery and coordination of necessary educational services and obtain, identify and refer children to mentoring, tutoring, vocational training and other services designed to enhance the educational prospects of foster children in Humboldt County.
FINANCIAL IMPACT:
The maximum amount payable or passed through by DHHS to HCOE for services rendered, and expenses incurred, pursuant to the terms and conditions of this MOU shall be based on the quarterly Federal Title IV-E discount rate for Humboldt County. The discount rate is established by the total number of federally eligible vs. non-federally eligible foster youth served per quarter. DHHS will submit a quarterly claim on behalf HCOE to the California Department of Social Services for the Title IV-E reimbursement. HCOE will be responsible for all non-federal costs associated with this MOU. The county Probation Department has no fiscal obligation to HCOE pursuant to this MOU. This agreement will have no impact on the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose to not approve the MOU for HCOE in collaboration with DHHS - CWS and Probation to provide and coordinate Educational Support for County Foster Youth (Title IV-E Foster Care Administrative Activities). This alternative is not recommended, as without the collaboration with HCOE, DHHS will be unable to provide the needed educational support services for Humboldt County foster children.
