RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Accept, and authorize the Humboldt County Purchasing Agent to execute and file the attached Notice of Completion regarding, the Humboldt County Correctional Facility Accessibility Improvement Project (4/5 vote required);

2.                     Approve the attached Supplemental Budget in the amount of Seventy-Three Thousand Five Hundred Six Dollars and Forty-Two Cents ($73,506.42) for ADA Internal Service Fund budget unit (3552-152) (4/5 vote required); and

3.                     Direct the Clerk of the Board to provide the County Administrative Office - ADA Compliance Team with one (1) fully executed certified copy of the Board Order related to this item.

DISCUSSION:

On December 8, 2020, the Humboldt County Board of Supervisors (“Board”) authorized staff to award the Humboldt County Correctional Facility Accessibility Improvement Project to Adams Commercial General Contracting, Inc. (“ACGC”) of Eureka, California for the base bid amount of One Million One Hundred Ten Thousand Seven Hundred Fifty-Six Dollars ($1,110,756.00).  The construction project renovated and improved accessibility features for the designated accessible showers, lavatories, toilets and handrails in each of the remaining housing units, replaced the second-floor inmate restroom door and renovated of one (1) of the staff restrooms on the second floor as well as remediated other miscellaneous barriers to access.  Non-accessible toilets, lavatories, urinals and showers were excluded from the project design and scope as the project was limited to removing barriers to access with the ADA accessible fixtures in the dormitories.  Non-accessible fixtures were to be largely left untouched as part of the original scope. 

 

On June 29, 2021, the Board authorized Change Order 1 in the amount One Hundred One Thousand One Hundred Ten Dollars and Sixty-Two Cents ($101,110.62), which added deferred maintenance repairs to the non-accessible showers and toilet facilities in housing unit 219 after County of Humboldt staff and ACGC located leaks and other deferred maintenance deficiencies within the non-accessible toilet and bathing facilities in the housing unit.

 

On November 8, 2022, the Board authorized Change Order 2 in the amount Two Hundred Twenty-Eight Thousand Two Hundred Twenty-Eight Dollars and Ninety-Four Cents ($228,228.94), which allowed for the repair of several of the non-accessible shower pans in housing units 334, 339, 320 and 555 in order to prevent water leakage from compromising the newly installed epoxy resin flooring as well as prevent water leakage to other areas of the building. This change order also addressed a number of other issues in the building such as corroded drain lines and electrical conduit issues that inhibited the construction of the new shower, as well as the security of ceiling spaces and an exterior window that was leaking.

 

On June 27, 2023, the Board authorized Change Order 3 in the amount of Thirty Thousand Thirty-Two Dollars and Eighty-Four Cents ($30,032.84), which allowed for repair of the flooring damaged by the removal of the shower surrounds, replacement of broken toilets that were damaged when they were removed for the epoxy flooring installation, installation of metal lath and plaster in a janitor’s closet, replacement of a mop sink and the elimination of a bathroom outlet.

 

ACGC has substantially completed their contract obligations and therefore the project can be accepted as complete in accordance with the contract documents.  The Board must accept the project prior to filing final acceptance.  After your Board’s acceptance, the required Notice of Completion can be filed with the Humboldt County Recorder and the mandatory thirty-five (35) day lien period can begin. Following completion of the lien period, the County of Humboldt can release or reduce the payment retention provided that no stop notices have been filed and any remaining contract work has been completed.

The final construction costs associated with the Humboldt County Correctional Facility Accessibility Improvement Project total One Million Four Hundred Seventy-Thousand One Hundred Twenty-Eight Dollars and Forty Cents ($1,470,128.40).  Approval of the attached Supplemental Budget will provide funds for the project retention amount of Seventy-Three Thousand Five Hundred Six Dollars and Forty-Two Cents ($73,506.42) in fiscal year 2023-2024.

 

STAFFING IMPACT:

Approval of the attached Notice of Completion and Supplemental Budget will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to accept the Humboldt County Correctional Facility Accessibility Improvement Project.  However, this alternative is not recommended as ACGC has completed their contractual obligations and therefore is entitled to release of retention at the conclusion of the thirty-five (35) day lien period.
