RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached professional services agreement with RG Legacy II, LLC regarding the provision of residential skilled nursing and mental health treatment services to adults with chronic physical and mental illnesses, in an amount not to exceed One Million Two Hundred Ninety-Four Thousand Seven Hundred Sixty Dollars ($1,294,760.00), for the period of June 14, 2024 through June 30, 2027;
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with RG Legacy II, LLC, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached professional services agreement with RG Legacy II, LLC to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
The Humboldt County Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”), in conjunction with the Humboldt County Public Guardian’s Office, utilizes a variety of placement options to provide long-term mental health treatment services to mentally ill clients who require assistance in locked and unlocked facilities. It is important for the placement team to have a variety of treatment options because vacancies and client needs fluctuate.
RG Legacy II, LLC, doing business as Pasadena Nursing Center, operates a locked skilled nursing facility located in Pasadena, California. RG Legacy II, LLC’s skilled nursing facility provides medical and mental health treatment services to individuals over eighteen (18) years of age who require twenty-four (24) hour monitoring in a residential setting due to the severity of their physical and mental illnesses. All the medical and mental health treatment services provided at RG Legacy II, LLC’s skilled nursing facilities are designed to transition clients to independent living within their communities, and are delivered with a wellness focus, which includes, without limitation, concepts of recovery and resilience.
Clients placed at RG Legacy II, LLC’s skilled nursing facility are monitored by the County of Humboldt’s multi-disciplinary Strategic Assistance for Adult Recovery Interventions (“SAFARI”) committee. The SAFARI committee authorizes services, determines the appropriate level of care and monitors client needs in the community upon discharge. When an initial placement at RG Legacy II, LLC’s skilled nursing facility occurs, transitional plans for less restrictive care are put in place, and reviewed monthly, in order to transition clients to community living as may appropriate.
The attached professional services agreement will allow eligible DHHS - Behavioral Health clients to receive skilled nursing and mental health treatment services at RG Legacy II, LLC’s skilled facility for the period of June 14, 2024, through June 30, 2027. It should be noted that the attached professional services agreement with RG Legacy II, LLC comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached professional services agreement with RG Legacy II, LLC regarding the provision of residential skilled nursing and mental health treatment services to adults with chronic physical and mental illnesses for the period of June 14, 2024, through June 30, 2027. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with RG Legacy II, LLC, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed long-term residential skilled nursing and mental health treatment services.

The attached professional services agreement with RG Legacy II, LLC has a maximum amount payable of One Million Two Hundred Ninety-Four Thousand Seven Hundred Sixty Dollars ($1,294,760.00) for the period of June 14, 2024, through June 30, 2027. In no event shall the maximum amount paid under the attached professional services agreement with RG Legacy II, LLC exceed Four Thousand Seven Hundred Sixty Dollars ($4,760.00) for fiscal year 2023-2024 and Four Hundred Thirty Thousand Dollars ($430,000.00) per year for fiscal years 2024-2025 through 2026-2027. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached professional services agreement with RG Legacy II, LLC in its entirety.
Expenditure appropriations related to attached professional services agreement with RG Legacy II, LLC have been included in the approved fiscal year 2024-2025 budget for DHHS - Behavioral Health budget unit 1170-496. Funding for the attached professional services agreement with RG Legacy II, LLC is available through Behavioral Health Realignment revenues received by DHHS - Behavioral Health.
STAFFING IMPACT:
Approval of the attached professional services agreement with RG Legacy II, LLC will not impact current staffing levels.
OTHER AGENCY INVOLVEMENT:
None
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached professional services agreement with RG Legacy II, LLC regarding the provision of long-term skilled nursing and mental health treatment services to adults with chronic physical and mental illnesses. However, this alternative is not recommended since it would require DHHS - Mental Health to place clients at inpatient facilities which will be more costly and may not provide the appropriate level of treatment for such clients.
