That the Board of Supervisors:
1. Approve the supplemental budget in the amount of $205,436 for Conflict Counsel (1100246) for the ADA barrier remediation at 515 J St. (4/5th Vote Required).

DISCUSSION:
On Nov. 7, 2023, the Humboldt County Board of Supervisors (“Board”) authorized the County of Humboldt to enter into a commercial lease with the owners of 515 J Street, Eureka, California, to relocate Conflict Counsel from their current location, which is a facility that was specifically listed in the 2018 Consent Decree with the Department of Justice for non-compliance with Title II of the Americans with Disabilities Act (“ADA”). Per the lease terms, the County of Humboldt agreed to remediate site arrival point barriers to access prior to program occupancy.
On June 29, 2021, your Board adopted the Humboldt County ADA Compliance Plan which requires all newly acquired leased facilities be in full compliance with Title II of the ADA prior to program occupancy.
On Dec. 8, 2023, the County of Humboldt entered into an agreement with Brokaw Design, Inc. for architectural design and construction oversight services necessary for the Conflict Counsel ADA Compliance Project and on April 9, 2024, your Board authorized the project to be publicly bid.
On April 30, 2024, the County of Humboldt received and opened two responsive and responsible bids with Sequoia Construction Specialties, Inc.’s. bid, of $160,081, being the lower of the two bids that were submitted. Sequoia Construction Specialties, Inc.’s base bid combined with design costs, internal project and support costs and project contingencies establishes an updated total estimated project cost of $290,436.
On May 21, 2024, your Board awarded the project to Sequoia Construction Specialties, Inc. At that time, due to the timeline of the county budget adoption, staff indicated that they would bring the attached supplemental budget for Conflict Counsel (1100246) for fiscal year (FY) 2024-25 to the Board to increase the fixed asset line for the remaining portion of the project estimate using County Administrative Office approved finance plan funding in the amount $205,436.

Narrative Explanation of Financial Impact:
Sufficient funding from the 2020 Finance Plan has been allocated for efforts related to acquisition of this property to support the increased costs of ADA barrier remediation.
The attached supplemental budget will increase the fixed asset line 8998-Building Improvements in Conflict Counsel’s budget (1100246) in the amount of $205,436, this amount combined with the $35,000 previously adopted with the FY 2024-25 budgets accounts for the remaining project total including the anticipated carryover from FY 2023-24 for architectural design.

The recommended actions will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board may choose not to approve the attached supplemental budget. However, this is not recommended as Conflict Counsel is currently located in a building that was specifically listed in the Consent Decree as having barriers to access as defined under Title II of the ADA and must be relocated. To do so, barrier remediation must occur at the 515 J Street location to relocate the program.
