Recommendation

That the Board of Supervisors:

1.                     Resolution to rescind resolution No. 24-48 proclaiming the existence of a facilities emergency at 600 West Clark, Eureka  pursuant to Sections 22050, et seq, of the California Public Contract Code as the emergency conditions no longer exists.

DISCUSSION:

On April 23, 2024, your Board approved agenda item 24-728 and executed associated resolution 24-48, which declared a facilities emergency pursuant to California Public Contract Code Sections 22050, to address the fire damage at the county leased facility at 600 West Clark Eureka. 

 

On March 2, 2024, a fire occurred at the Dept. of Health and Human Services’ leased facility at 600 West Clark Street, Eureka.  The county’s initial estimate of repair when the emergency declaration was approved on April 23, 2024, was over $70,000.  This would have required the county to undergo a public bidding process that would have been extremely time-consuming and would have extended the time of repair by several months.  This emergency facilities declaration allowed the county to have the damage repaired in a relatively quick and timely manner.

 

The fire mitigation repair work is complete, and staff would like to rescind the April 23, 2024 emergency declaration per Public Contract Code 22050.  Approval of this Agenda Item will close this emergency.

Narrative Explanation of Financial Impact:

Funding for the needed abatement, remediation and cleanup work is available through preliminary insurance proceeds provided by the County of Humboldt’s insurance carrier.  The total cost of repair is estimated to be over $70,000. The deductible shall be $25,000, the remaining balance will be billed to the insurance company.  The $25,000 will come from the Professional Services liability Fund (3524354-2118) the remaining funds will come from Social Services budget, 1160511,  until reimbursed by insurance.

This Board action will not impact staffing.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

Your Board may decide not to approve this action to rescind the declared facilities emergency at 600 West Clark, Eureka.  This is not recommended as California Public Contract Code 22050 requires the governing body to terminate the action at the earliest possible date that conditions warrant.
