RECOMMENDATIONS:Recommendation
That the Board of Supervisors:
1. Waive the requirements of the Humboldt County Nuclear-Free Ordinance with regard to the attached memorandum of understanding with the California Governor’s Office of Emergency Services;
2. Approve, and authorize the Information Technology Director, or a designee thereof, to execute, the attached memorandum of understanding with the California Governor’s Office of Emergency Services regarding participation in information sharing activities with the California Cyber Security Integration Center; and
3. Authorize the Information Technology Director, or a designee thereof, to execute any and all future amendments to, and any other agreements and/or documents that are necessary to effectuate, the attached memorandum of understanding with the California Governor’s Office of Emergency Services after review and approval by County Counsel and Risk Management.

DISCUSSION:
The Cybersecurity Information Sharing Act of 2015 encourages the sharing of “cybersecurity threat information with private entities, non-federal government agencies, state, tribal, and local governments, the public and entities under threats,” in order to reduce the likelihood and severity of cyber incidents that may significantly compromise the security and resilience of public and/or private sector information and communications technologies.
The attached memorandum of understanding with the California Governor’s Office of Emergency Services will formalize the County of Humboldt’s participation in information sharing activities with the California Cyber Security Integration Center in accordance with any and all applicable local, state and federal laws, regulations and standards. Pursuant to the terms and conditions of the attached memorandum of understanding with the California Governor’s Office of Emergency Services, only network traffic metadata generated by the County of Humboldt’s on-site security appliances, vulnerability assessments and security audit reports will be shared. It should be noted that the Board must waive the requirements of the Humboldt County Nuclear-Free Ordinance in order to approve the attached memorandum of understanding, since the California Governor’s Office of Emergency Services is unable to comply with the requirements set forth therein.
Accordingly, staff recommends that the Board approve, and authorize the Information Technology Director, or a designee thereof, to execute the attached memorandum of understanding with the California Governor’s Office of Emergency Services regarding participation in information sharing activities with the California Cyber Security Integration Center. It is also recommended that the Board authorize the Information Technology Director, or a designee thereof, to execute any and all future amendments to, and any other agreements and/or documents that are necessary to effectuate, the attached memorandum of understanding with the California Governor’s Office of Emergency Services, after review and approval by County Counsel and Risk Management, in order to avoid any unnecessary delays in needed information sharing.
FINANCIAL IMPACT:
There are no costs associated with the attached memorandum of understanding with the California Governor’s Office of Emergency Services. As a result, approval of the attached memorandum of understanding with the California Governor’s Office of Emergency Services will not impact the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, building inter-jurisdictional and regional cooperation, providing for and maintaining infrastructure and creating opportunities for improved safety and health.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve, and authorize the Information Technology Director, or a designee thereof, to execute, the attached memorandum of understanding with the California Governor’s Office of Emergency Services regarding participation in information sharing activities with the California Cyber Security Integration Center. However, this alternative is not recommended since it will leave the County of Humboldt more vulnerable to cyber security threats.
