Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Department of Public Works - Solid Waste Division to issue, the attached Request for Proposals regarding management of a countywide Edible Food Recovery Program on March 2, 2023 with all Proposals due no later than March 31, 2023 at 4:00 p.m. as required by Section 10344 of the California Public Contracts Code; and

2.                     Direct the Department of Public Works - Solid Waste Division to return to the Board with a professional services agreement regarding the provision of Edible Food Recovery Program Management once the review, evaluation, selection, contract negotiation and approval processes set forth in the attached request for proposals have been completed.

DISCUSSION:

On Dec. 13, 2022, your Board received a presentation from Department of Public Works Solid Waste staff on Humboldt County’s SB 1383 Organic Waste Recycling Update. Staff provided information on the California Department of Resources Recycling and Recovery (CalRecycle)’s requirements that all California jurisdictions must adhere to along with a status update on Humboldt County’s current compliance. Part of the statewide effort to reduce emissions of short-lived climate pollutants (SLCP) in California, requires a rescue of at least 20% of currently disposed edible food. To help meet this goal, staff and regional partners from all jurisdictions within Humboldt County have agreed to work collaboratively on developing a regional Edible Food Recovery Program.

 

SB 1383 regulations required California jurisdictions to come into compliance by Jan. 1, 2022; however, the county received an extension on its compliance deadlines by submitting a Notice of Intent to Comply (NOIC). The NOIC requires the county to abide by a Corrective Action Plan (CAP), which identifies the steps and timelines necessary for the county to come into compliance with SB 1383.  The development of an edible food recovery program is included in the county’s CAP. Failure to achieve stated goals and timelines in CAPs may result in fines by the State of California.

 

To address the need for a regional Edible Food Recovery Program, and to avoid potential fines for non-compliance with SB 1383, Public Works Solid Waste Division has taken steps to lead the development and release of a Request for Proposals (RFP) on behalf of the county and participating jurisdictions. The selected proposal seeks to award a firm with a one (1) year contract for program development, program coordination, outreach and education, capacity planning and compliance assessments, recordkeeping and reporting and overall program evaluation.

 

A regional approach to managing an Edible Food Recovery Program will help mainstream the program and provide consistent communications to all jurisdictions. The County has received letters of commitment from each municipal jurisdiction within the county to participate in a cost-share for Edible Food Recovery Program Management through this RFP. Funding contribution amounts were determined based on participating jurisdictions' populations. Jurisdictions will pay approximately $0.89 per person to fund the annual position amount not to exceed $120,000. The county’s share of this project will be $63,628.32, based on the population of people not living in incorporated areas, which is 71,444.

 

Public Works will bring the awarded contract back to the Board, along with a Memorandum of Understanding between the County and participating jurisdictions, for approval and adoption at a future meeting.

 

FINANCIAL IMPACT:

The estimated total cost for Edible Food Recovery Program Management described in the attached request for proposals is not to exceed $120,000.  Participating jurisdictions will contribute to the county through a cost share based on population. The County of Humboldt’s share of this project will be $63,628.32, based on the population of people not living in incorporated areas, which is 71,444. Expenditure appropriations related to the Edible Food Recovery Management Program will be incorporated into the proposed fiscal year 2023-24 Solid Waste budget unit 3691-438.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to authorize the Director of Public Works to approve and authorize the attached request for proposals regarding management of a countywide Edible Food Recovery Program or direct the Public Works - Solid Waste Division to return to the Board with a professional services agreement regarding the provision of Edible Food Recovery Program Management once the review, evaluation, selection, contract negotiation and approval processes set forth in the attached request for proposals have been completed. However, this decision would result in non-compliance with State mandates and the County and municipal jurisdictions could receive fines up to $10,000 per day for non-compliance.
