RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve the Humboldt County Workforce Innovation and Opportunity Act (WIOA) Memorandum of Understanding (MOU) between the Humboldt County Workforce Development Board (HC-WDB) and America’s Job Center of California (AJCC) partners (Attachment 1);

2.                     Approve the Resolution Approving the America’s Job Center of California Memorandum Of Understanding For Program Years 2019-2022 and authorize the Chair of the Board to sign the Memorandum of Understanding;

3.                     Direct county staff, as identified in the MOU to sign the agreement;

4.                     Direct the Clerk of the Board to return two (2) copies of the Humboldt County WIOA AJCC MOU to the CAO/Economic Development; and

5.                     Approve Chair of the Board to sign the letter to Tim Reynaga transmitting the MOU to EDD.

DISCUSSION:

In July 2014, the US Congress passed and the President signed the Workforce Innovation and Opportunity Act (WIOA), P.L. 113-128, which is administered in California by the California Employment Development Department (EDD). The WIOA and EDD Guidelines and Directives require the Humboldt County Workforce Development Board (HC-WDB) to designate or certify AJCC operators through a competitive process and enter into a MOU with AJCC operators and partners. On June 28, 2016 the Board of Supervisors approved the prior MOU between the HC-WDB and all AJCC partners. Required partners and programs include:

 

                     WIOA Title I Adult, Dislocated Worker, Smart Business Resource Center (SBRC)

                     WIOA Title I Youth, Redwood Community Action Agency (RCAA)

                     WIOA Title II Adult Education and Literacy, College of the Redwoods (CR)

                     WIOA Title III Wagner-Peyser, Employment Development Department (EDD)

                     WIOA Title IV Vocational Rehabilitation, Department of Rehabilitation (DOR)

                     Carl Perkins Career Technical Education, College of the Redwoods (CR)

                     Community Services Block Grant, Redwood Community Action Agency (RCAA)

                     Native American Programs (Section 166), Northern California Indian Development Council (NCIDC)

                     Title V, American Association of Retired Persons (AARP)

                     Temporary Assistance for Needy Families, Department of Health and Human Services, CalWORKs

                     Unemployment Insurance, Employment Development Department (EDD)

                     Veterans, Employment Development Department (EDD)

                     Trade Act, Employment Development Department (EDD)

                     Migrant Seasonal Farmworkers, California Human Development (CHD)

 

In additional to the required partners, your Board approved two agencies to become AJCC partners to provide business services:

                     Sequoia Personnel Services (SPS)

                     North Coast Small Business Development Center (NCSBDC)

 

The MOU process in 2016-2017 took place in two phases. Phase I of the MOU addresses service coordination and collaboration amongst partners. Phase II addressed how to functionally and fiscally sustain the unified system described in Phase I, through the use of resource sharing and joint infrastructure costs. Phase I was approved by your Board at the June 28, 2016 meeting, and Phase 2 was approved at the August 22, 2017 meeting. The MOU contained an assurance that it would be reviewed and updated every three years with an annual review of and, if necessary, amendment of the Infrastructure Funding Agreement (IFA) and Other System Costs Budget. The EDD Directive WSD18-12 provides the opportunity to develop a single “umbrella” MOU that addresses overarching issues for the HC-WDB, the Board of Supervisors and AJCC Partners, which results in this MOU. The HC-WDB is making a recommendation to your Board to approve and adopt the AJCC MOU for 2019-2022 and direct the Chair to sign.

 

The HC-WDB will continue to maintain responsibility for oversight of all activities that fall under the AJCC MOU. This will include the development of quarterly reports, review of the MOU every three years, and ongoing for the AJCC operations.

 

FINANCIAL IMPACT:

SBRC, SPS and NCSBDC will utilize WIOA funds to deliver the WIOA programs through the AJCC. The State releases funding allocations annually and this varies year to year. The total amount of WIOA funds for 19-20 is estimated to be $776,500. The MOU’s term is a three year period, and the total estimated funds during the three years is $2,329,500. In the event that any discretionary funds become available, the SBRC, SPS and NCSBDC could be awarded additional funds.

This action supports your Board’s Strategic Framework by supporting business, workforce development and creation of private-sector jobs.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Your Board could choose not to approve the Memorandum of Understanding between the Humboldt County Workforce Development Board and the America’s Job Center of California partners. This alternative is not recommended because declining this MOU would impact the partnership and make access to system services more challenging for Humboldt County residents and employers.
