RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Accept the completed contracts, including any and all approved change orders, with GR Sundberg, Inc., regarding the construction of Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67; and

2.                     Approve the final claims for payment, totaling Four Hundred Twenty-Five Dollars ($425), to be submitted by the Engineering Division of the Department of Public Works to the Auditor-Controller’s Office, which will bring the total amounts paid to 100% for each contract; and

3.                     Direct the Clerk of the Board to provide the Engineering Division of the Department of Public Works with one (1) fully executed certified copy of the Board order related to this item.

DISCUSSION:

On Feb. 21, 2019, the Governor of the State of California declared a disaster for Humboldt County due to severe winter storms, flooding and mudslides.  Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67, located in the Briceland area of southern Humboldt County, experienced roadway settlement and shoulder failure.  Emergency temporary repairs were performed at the time of the disaster to maintain essential traffic and prevent further damage to the roadway.

 

On Feb. 24, 2022 and Sept. 22, 2022, the Humboldt County Department of Public Works (“Public Works”) received Federal Highway Administration funding approval to proceed with Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67.  GHD, Inc., prepared plans and specifications for the project based on topographic surveys of the damaged areas prepared by Points West Surveying and geotechnical studies prepared by Crawford and Associates.  The work consisted of constructing a soldier pile wall and rock buttress, installing subsurface and surface drainage systems, installing guardrails, reconstructing the roadway to original width and installing erosion and sediment control items.

 

On March 21, 2023, the Humboldt County Board of Supervisors (“Board”) authorized the Clerk of the Board to advertise Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67 for bids.  On May 2, 2023, the County of Humboldt received three (3) bids for the project. On May 23, 2023, the Board awarded the project agreement to GR Sundberg, Inc., the lowest responsive bidder.  The award amount was Three Million One Hundred Thirty-Nine Thousand Two Hundred Fifty-Three Dollars and Seventy-Five Cents ($3,139,253.75). 

 

Contract change orders executed during the project increased the authorized amount for Post Mile 3.08 by Eighty-Four Thousand Thirty-Four Dollars and Ninety-Two Cents ($84,034.92). These change orders are associated with removing additional trees to resolve utility conflicts, extended rental of the temporary traffic signal and increases in bid item quantities due to adjustments to field conditions.

 

Contract change orders executed during the project decreased the authorized amount for Post Mile 5.67 by Fifteen Thousand Two Hundred Fifty-Two Dollars and Eighty-Four Cents ($15,252.84).  These change orders are associated with removing a buried man-made object to resolve the conflict with the new storm drain and increases and decreases in bid item quantities due to adjustments to field conditions.

 

Accordingly, Public Works recommends that the Board: accept the completed contracts, including all approved change orders, and approve the final claims for payment in the amount of Two Hundred Twelve Dollars and Fifty Cents ($212.50) for each of the two contracts.

Total construction costs for Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67 are Three Million Two Hundred Eight Thousand Thirty-Five Dollars and Eighty-Three Cents ($3,208,035.83).  Progress payments totaling One Million Nine Hundred Fifty-Two Thousand Seven Hundred Eighty-Six Dollars and Ninety-Seven Cents ($1,952,786.97) have been paid for Post Mile 3.08, and the final claim for payment in the amount of Two Hundred Twelve Dollars and Fifty Cents ($212.50) is outstanding.  Progress payments totaling One Million Two Hundred Fifty-Four Thousand Eight Hundred Twenty-Three Dollars and Eighty-Six Cents ($1,254,823.86) have been paid for Post Mile 5.67, and the final claim for payment in the amount of Two Hundred Twelve Dollars and Fifty Cents ($212.50) is outstanding.

 

Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67 is funded by Federal Highway Administration Emergency Relief funds (88.53%) and the Humboldt County Road Fund (11.47%).  Expenditure appropriations relating to completion of Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67 are included in the approved fiscal year 2024-2025 budget for budget unit 1200-321.  The amount shown in the Financial Impact Table above does not include Progress Payments Number 1 through 8 for Post Mile 3.08, which total One Million Three Hundred One Thousand Six Hundred Ninety Dollars and Twenty-Two Cents ($1,301,690.22), and Progress Payments Number 1 through 6 for Post Mile 5.67, which total One Million Two Hundred Thirty-Six Thousand Seventy-Four Dollars and Twenty-Two Cents ($1,236,074.22), because this work was performed in fiscal year 2023-2024.

 

Projects are paid in arrears with anticipated funding coming from the Federal Highway Administration as mentioned above.  The fiscal year 2023-2024 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of Seven Million Eight Hundred Thousand Dollars ($7,800,000.00) in the Humboldt County Road Fund.  Even after allocating nearly Six Million Eight Hundred Thousand Dollars ($6,800,000.00) of American Rescue Plan Act funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately Thirteen Million Nine Hundred Thousand Dollars ($13,900,000.00).

 

This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements, which can take years for the County of Humboldt to receive.  The current total of outstanding repayments is approximately Seven Million Five Hundred Thousand Dollars ($7,500,000.00).  Public Works utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects.  Despite the use of additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

 

STAFFING IMPACT:

The recommended actions will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board of Supervisors may choose not to accept Storm Damage Repair to Briceland Thorne Road (F5A010) Post Miles 3.08 and 5.67.  However, this alternative is not recommended because the project has been completed, and the recommended actions are needed to accept the contracts.
