Recommendation
That the Board of Supervisors:
1. Approve and authorize Interim Chief Probation Officer, Coral Sanders, to execute the attached professional services agreement with the Boys and Girls Club, Teen Court regarding juvenile diversion services in the amount of $232,619 for the period of July 1, 2023 through June 30, 2026;
2. Authorize the Interim Chief Probation Officer, Coral Sanders, to execute any and all subsequent amendments to the attached professional services agreement with Boys and Girls Club of the Redwoods, Teen court after review and approval by County Counsel, Risk Management and the County Administrative Office;
3. Approve the attached supplemental budget for Probation Budget Unit 202 in the amount of $75,180.

DISCUSSION:
On February 23, 2023, the Multi-Agency Juvenile Justice Coordinating Council (MAJJCC) heard a proposal from Boys and Girls Club of the Redwoods, Teen Court (herein referred to as Teen Court) regarding a 3-year funding request to extend Teen Court programming down into the Eel River Valley. A discussion ensued which included a recommendation that Teen Court attempt to pursue alternative funding for this expansion and return with a proposal and details about funding attempts if that failed to produce funding. On May 25, 2023, Teen Court returned with a proposal and detailed for the MAJJCC the attempts made to secure funding. A vote was taken and the motion to approve this funding carried. Funds will be encumbered for Fiscal Years 2023-24, 2024-25 and 2025-26 however Teen Court will be responsible for returning the MAJJCC each year with a request for funding for the following fiscal year and to present other avenues of funding pursued.
In this proposal, Teen Court will establish Teen Court programming in the Eel River Valley in order to increase access to youth substance abuse prevention, early intervention, mentoring, and peer education resources. They plan to do this through Teen Court hearings, attendance councils, the YOUth Choose Prevention Program, and the after-school program for teen volunteers which includes preventative education, leadership development, service learning, trainings in civic responsibility, as well as positive mentoring with caring adults while functioning as an innovative juvenile diversion program where teens, who have taken responsibility for their offense, agree to have their case heard by their peers.
Accordingly, the Humboldt County Probation Department recommends that the Board of Supervisors approve and authorize the Interim Chief Probation Officer to execute the attached professional services agreement with Teen Court regarding the provision of juvenile diversion services in the Eel River Valley for the period of July, 2023 through June, 2025. Staff also recommends that the Board authorize the Interim Chief Probation Officer or Chief Probation Officer to execute any and all subsequent amendments to the attached professional services agreement with Teen Court after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed juvenile diversion services in the Eel River Valley.
FINANCIAL IMPACT:
The attached professional services agreement with Boys and Girls Club of the Redwoods, Teen Court, has a total payable of $232,619 for the period of Fiscal Years (FY) 2023-24 through 2025-26. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached professional services agreement with Boys and Girls Club of the Redwoods, Teen Court.
Expenditure appropriations related to the attached agreement was not included in the approved FY 2023-24 budget for the Probation Department, budget unit 202. Funding for the attached professional services agreement with Boys and Girls Club of the Redwoods, Teen Court is available through the Probation Department’s Juvenile Justice Crime Prevention Act trust (3741-000-810515) which has a current balance of $1,559,433.11 (this figure only includes Probation’s juvenile justice allocation, COPS funds also reside in this trust). A supplemental budget has been included in this item and as a result, approval of the agreement with Boys and Girls Club of the Redwoods, Teen Court will not impact the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the agreement or allow the Interim Chief Probation Officer to sign such agreements, however this alternative is not recommended as it could delay or prevent much needed juvenile diversion services from reaching the youth who need them.
