RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Authorize the Chair of the Board to sign three (3) original copies of the Tower and Space License between the County of Humboldt and the Hoopa Valley Tribe for the Sugar Pine Mountain Communications Site; and
2. Direct the Clerk of the Board to return two (2) fully executed copies of the Tower and Space License to Public Works Facility Management.

DISCUSSION:
Sugar Pine Mountain is a communications site located southwest of Hoopa, within the Hoopa Reservation (Exhibit A - Vicinity Map). The site has been providing the Humboldt County Sheriff Office with radio coverage in the general area since June of 2014, subject to a Tower and Space License (Exhibit B - 2014 Tower and Space License).
The Humboldt County Radio System Replacement Project has been underway since 2019, to upgrade its radio systems throughout the county for enhancement of the Sheriff and public service radio coverage. A review of the Sugar Pine Mountain Site indicated the need to replace its solar array that supplies power to the radio system. An amendment was planned at that time to incorporate the new solar array and to extend the license for an additional five (5) years. However, due to budget restraints, the project was cancelled. The amendment was therefore never pursued, and the license expired on May 21, 2019.
Since the license has expired, a new license is required for continued use of the site. The Hoopa Reservation is aware of the site and use and has no objection to a new Tower and Space License for continued use with no changes to its equipment for a five (5) year term.
Attached is the proposed License for approval and execution by your Board (Attachment No. 1 - Sugar Pine Tower and Space License).
FINANCIAL IMPACT:
There is no financial impact as the facilities used are existing with no plans to replace or add any future equipment. No rent applicable based on public service provided to the Hoopa Area. There will be no impact to the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could decide not to approve the proposed Tower and Space License. However, this is not recommended as the current use would not be covered by the provisions of a license agreement and thus be subject to use termination by the Hoopa Valley Tribal Office.
