Recommendation
That the Board of Supervisors:
1. Receive staff report; and
2. Approve conflict of interest codes submitted by Alderpoint County Water District

DISCUSSION:
The County Board of Supervisors, as the code reviewing body for county agencies, is tasked with reviewing Conflict of Interest Codes submitted by special and school districts and doing one of the following: (a) approve the proposed code as submitted, (b) revise the proposed code and approve it as revised, or (c) return the proposed code to the agency for revision and resubmission within 60 days. Alderpoint County Water District has submitted a Conflict of Interest Code for review by the County Board of Supervisors.
According to Government Code Section 87309, “A conflict of interest code or amendment shall not be approved by the code reviewing body or upheld by a court if it: (a) fails to provide reasonable assurance that all foreseeable potential conflicts of interest situations will be disclosed or prevented; (b) fails to provide to each affected person a clear and specific statement of that person’s duties under the code; or (c) fails to adequately differentiate between designated employees with different powers and responsibilities.”
