RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached agreement with the Del Norte County Probation Department regarding the placement of juvenile court wards from Del Norte County in the Humboldt County Juvenile Hall in the amount of $227 per ward, per day not to exceed a total of $300,000 per fiscal year for the period of July 1, 2025 through June 30, 2027; and
2. Authorize the Chief Probation Officer to execute any and all subsequent amendments to the attached agreement with Del Norte County Probation Department, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one fully executed original copy of the attached agreement with Del Norte County Probation Department to: Ellisha Hardison, Legal Office Business Manager for Humboldt County Probation, for further processing.

DISCUSSION:
Del Norte County Probation Department continues to work on closing its Juvenile Hall and seeking to enter extend or renew its agreement with Humboldt County Probation regarding the placement of juvenile court wards pursuant to Welfare and Institutions Code § 870 and Government Code 6500 et seq. Under this agreement, Humboldt County shall be able to exercise all powers necessary to operate a Juvenile Hall which are vested in the County of Del Norte and the Del Norte County Probation Department pursuant to Welfare and Institutions Code § 850 et seq. Per agenda item 23-110 on Feb. 7, 2023, your Board executed a similar contract with Del Norte County for the placement of juvenile court wards at the Humboldt County Juvenile Hall for the period of February, 2023 through June 30, 2025.
The Humboldt County Probation Department currently operates a juvenile hall comprised of a 30-bed secure detention facility for youth who come under the jurisdiction of the juvenile court as well as the New Horizons program. New Horizons is a 6-month detention program operated in conjunction with the Department of Health and Human Services. Participants are provided a wide array of mental health, substance use disorder, and cognitive behavioral treatment services. This budget unit further contains the Secure Youth Treatment Program (SYTP) for court-ordered youth who have been adjudicated for an offense listed in 707(b) of the Welfare and Institutions Code.
Accordingly, the Humboldt County Probation Department recommends that the Board of Supervisors approve, and authorize the Chair to execute, the attached agreement with Del Norte County Probation Department regarding the provision of placement for juvenile wards for the period of July 1, 2025 through June 30, 2027. Staff also recommends that the Board authorize the Chief Probation Officer to execute any and all subsequent amendments to the attached agreement with the Del Norte County Probation Department, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed placement of juvenile wards coming from Del Norte County.
This agreement term spans July 1, 2025 through June 30, 2027. The addition of a mental health daily rate in this agreement required coordination and negotiation between Children’s Behavioral Health, Humboldt County Probation, and Del Norte County Probation to produce, refine, and agreed upon calculations for this daily rate. That process as well as some internal routing delays in Del Norte County prevented this agreement from coming to your Board for approval earlier.
SOURCE OF FUNDING:
Del Norte County Probation (Miscellaneous revenue 1100234-707010). This revenue is expected to offset any expenses relating to the detention of these juvenile wards.

Narrative Explanation of Financial Impact:
The attached agreement with Del Norte County Probation charges $227 per ward, per day which is comprised of a $175 juvenile Hall daily rate and a $52.00 mental health services rate which Children’s Behavioral Health via pass-through from the Probation Department. This agreement has a total maximum payable of $600,000 for the period of July 2025 through June 30,2027. However, in the event local, state or federal funding is reduced or eliminated, either county may reduce the above-referenced maximum amount payable or terminate the attached agreement.

Narrative Explanation of Staffing Impact:
There is no staffing impact as a result of this agreement. The Juvenile Hall has adequate staffing levels to accept the Del Norte youth without the need to hire additional staff.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the agreement or allow the Chair to sign such agreements, however, this alternative is not recommended as Del Norte County Probation is closing its juvenile hall and accepting placement of juvenile court wards from Del Norte builds regional cooperation and provides a much needed service.
