RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Authorize the Director of Public Works to sign a Transportation Art Maintenance Agreement with CalTrans for the Clean California funded art projects on the Herrick Avenue Overpass and at the Herrick Avenue Park and Ride; and

2.                     Further Authorize the Director of Public Works to sign a forthcoming Memorandum of Agreement with the City of Eureka delegating maintenance responsibilities after review and approval by County Administrative Office, County Counsel and Risk Management.

DISCUSSION:

As part of this year’s Eureka Street art project, the City of Eureka is having a mural painted on the Herrick Avenue overcrossing and is having a mural painted at the Herrick Avenue Park and Ride.  These projects are being funded through Clean California grant funds controlled by CalTrans.  As part of this effort, in accordance with CalTrans requirements, a Transportation Art Maintenance Agreement is necessary to ensure the future cost of the maintenance of the art.  The funding requirements also require that such Transportation Art Maintenance Agreements must be with the jurisdiction in which the art occurs.  Both of the locations are within the unincorporated county of Humboldt.

 

The City of Eureka has agreed to take on the maintenance; however, CalTrans cannot have the Transportation Art Maintenance Agreement directly with the city due to funding source requirements. The county is developing an agreement with the City of Eureka to pass these maintenance agreements onto the city.

 

The Transportation Art Maintenance Agreement is still being finalized, a template of the agreement is attached.  As city staff have already agreed to take on the maintenance, there is low risk to authorizing the Director to have the authority to sign the Agreement as soon as it is completed.

There is no financial impact from this action as all maintenance will be passed on to the City of Eureka and funded by the City of Eureka.
