RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Assistant Department of Health and Human Services Director, or a designee thereof, to execute, the attached fourth amendment to the professional services agreement with California Forensic Medical Group regarding the provision of healthcare services at Humboldt County correctional and detention facilities;

2.                     Authorize the Assistant Department of Health and Human Services Director, or a designee thereof, to execute any and all subsequent amendments to the professional services agreement with California Medical Forensic Group, after review and approval by County Counsel, Risk Management and the County Administrative Office;

3.                     Direct the Clerk of the Board to return one fully executed copy of the attached fourth amendment to the professional services agreement with California Medical Forensic Group to the Department of Health and Human Services - Contracts Unit for further processing; and

4.                     Approve the attached supplemental budget and authorize the Auditor-Controller to supplement Fund 1100, Budget Unit 490, Medical Care for fiscal year 2021-2022 (4/5 Vote Required).

DISCUSSION:

The California Penal Code and Title 15 of the California Code of Regulations - Minimum Standards for Local Detention Facilities require counties to provide emergency and basic medical services to all adults and minors held in county correctional and detention facilities.  Since 2002, the County of Humboldt has contracted with California Forensic Medical Group (“CFMG”) regarding the provision of such healthcare services.

 

On Oct. 4, 2016, the Board approved the current professional services agreement with CFMG regarding the provision of healthcare services at Humboldt County correctional and detention facilities for the period of Oct. 1, 2016 through Sept. 30, 2021.  The current professional services agreement with CFMG was subsequently amended on Dec. 13, 2016, Feb. 28, 2020 and Aug. 21, 2020 in order to expand the scope services provided, increase the maximum amount payable, adjust the rates of compensation and modify the reporting and execution requirements set forth therein.

 

The Humboldt County Department of Health and Human Services (“DHHS”) has been collaborating with Humboldt County Sheriff’s Office regarding the development of a Request for Proposals (“RFP”) for the provision of emergency and basic medical services at Humboldt County correctional and detention facilities.  Due to the COVID-19 pandemic, additional time is necessary to complete the RFP process for the provision of healthcare services at Humboldt County correctional and detention facilities. 

 

The attached fourth amendment to the current professional services agreement with CFMG will extend the term through Mar. 31, 2022 in order to allow the County of Humboldt to complete the above-referenced RFP process.  The attached fourth amendment to the current professional services agreement also eliminates CFMG’s responsibility to cover any outside medical expenses for the period of Oct. 1, 2021 through Mar. 31, 2022 due to a higher volume of inmates requiring extensive off-site medical treatment over the past year.  Pursuant to the terms and conditions of the attached fourth amendment to the current professional services agreement, CFMG will bill the County of Humboldt for any and all off-site medical treatment provided to inmates at Humboldt County correctional and detention facilities, including, without limitation, any and all costs related to ambulance transports, emergency room visits, outside medical office visits, one-day surgery and radiology.  The County of Humboldt is currently in the process of enrolling in the California Department of Health Care Services’ Medi-Cal County Inmate Program which will allow the bulk of these additional expenses to be covered by Medi-Cal.

 

Accordingly, DHHS recommends that the Board approve, and authorize the Assistant DHHS Director, or a designee thereof, to execute, the attached fourth amendment to the current professional services agreement with CFMG regarding the provision of healthcare services at Humboldt County correctional and detention facilities.  It is also recommended that the Board authorize the Assistant DHHS Director, or a designee thereof, to execute any and all subsequent amendments to the current professional services agreement with CFMG, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed healthcare services at Humboldt County correctional and detention facilities.

 

FINANCIAL IMPACT:

The attached fourth amendment to the current professional services agreement with CFMG will not increase the maximum base amount payable.  However, it does eliminate CFMG’s responsibility for covering any outside medical expenses for the period of Oct. 1, 2021 through Mar. 31, 2022, which will result in an estimated cost increase of approximately $500,000. The attached supplemental budget will augment Fund 1100, Budget Unit 490, Medical Care in order to cover the additional cost associated with the attached amendment.  The amendment is supported by California Assembly Bill 109, Humboldt County General Fund and Tobacco Lawsuit Funds.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to approve the attached fourth amendment to the current professional services agreement with CFMG regarding the provision of healthcare services at Humboldt County correctional and detention facilities.  However, this alternative is not recommended as it would disrupt the provision of mandated medical services provided at Humboldt County correctional and detention facilities.
