RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receive and file the bids for Consent Decree Barrier Removal for the Mental Health Facility ADA project number 2018-402;
2. Award the project to the lowest responsible and responsive bidder, Adams Commercial General Contracting, Inc.;
3. Authorize the Purchasing Agent to sign the construction agreement with Adams Commercial General Contracting, Inc., in the form of the attached sample agreement subject to approval from County Counsel and Risk Management; and
4. Adopt the supplemental budget depicted below for the ADA Compliance budget unit (4/5 vote required).

DISCUSSION:
On December 10, 2018, the County of Humboldt entered into a consultant services agreement with Brokaw Designs to design ADA improvements at the Mental Health Facility. The Consent Decree requires the county to perform ADA alterations at this facility for the following items: provide three (3) accessible parking stalls; install an accessible pedestrian path of travel to the public right of way, alter four (4) restrooms including one (1) shower; and renovate two (2) service counters inside the facility.
On April 2, 2019, your Board authorized the Mental Health ADA project to be advertised for public bid. On May 1, 2019, the county received and opened two (2) responsive bids and the results are as follows:

Adams Commercial General Contracting, Inc. - Eureka, California $283,005
The general conditions set forth in the project specifications manual require that the project be awarded on the merits of the lowest qualified, responsible and responsive base bid. Staff recommends that your Board award this project to Adams Commercial General Contracting, Inc., Eureka, California for the total base bid award amount of $283,005.
FINANCIAL IMPACT:
The ADA Compliance budget has budgeted $252,438 in the current fiscal year for accessibility upgrades at the Mental Health Facility. The current project expenses combined with the Adams Commercial General Contracting, Inc. base bid amount of $283,005 establishes a project cost of $336,608. A supplemental budget is needed due to costs exceeding project estimates. Unanticipated costs total $84,170. There are sufficient funds in the ADA Trust to support this request.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to approve the recommendations to award this project however, this is not recommended as the county may be subject to fines for non-compliance, as the Mental Health Facility is a facility identified by the Department of Justice (DOJ) with ADA barriers that must be removed prior to the termination of the consent decree.
