DISCUSSION:

Pursuant to California Welfare and Institution Code Sections 4330, et seq., the California Mental Health Services Authority contracts with the California Department of State Hospitals regarding the use of state hospital facilities on behalf of counties participating in the State Hospitals Program.  The attached memorandum of understanding with California Department of State Hospitals and the California Mental Health Services Authority will allow the Humboldt County Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”) to place Humboldt County clients who require twenty-four (24) hour supervision at any of the five (5) state hospitals, when no other facilities are available, for the period of July 1, 2025 through June 30, 2027.

Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities for the period of July 1, 2025 through June 30, 2027.  It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the placement of Humboldt County clients at state hospital facilities.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the attached memorandum of understanding with the California Department of State Hospitals and the California Mental Health Services Authority regarding the use of state hospital facilities.  However, this alternative is not recommended since it would prevent DHHS - Behavioral Health from placing Humboldt County clients who require twenty-four (24) hour supervision at state hospital facilities when no other facilities are available.
